Impeachment is POLITICAL Action. It has no authority in the Criminal System. Anyone who poses else is blustering!

Totally up to the Senate. They have done so in the past.

A better question is, ‘Is it even Constitutional?’

Oh, never mind! With SCOTUS Chief Just Us ‘Go with the flow, make no waves’ Roberts, what need is there for ‘Constitutionality’?

No. Mitch is trying to unconstitutionally purge a private citizen from running for office again.

If there's one thing the last 4 years have taught us is that Democrats can do whatever they feel like doing.

No. A Senate trial constitutes a Bill of Attainder. And Impeachment only possible to those who hold office.

Can a private citizen be tried by the senate???

No, a private citizen cannot be tried , detained, arrested jailed or executed by an act of Congress.

Historically such acts were perpetrated by the Crown prior to the American Revolution in 1776. These were often Bills of Attainder signed by British Governors of the colonies, without trial or due process. Often the persons lands and estates were also seizedm and a person jailed without trial. all one had to do is be in opposition to the Crown or have been, or perhaps the Governor wanted the persons land.\

The founding fathers sought to prevent Government from exercising legislative powers to persecute any individual.
And so we have :

US Constitution: Article I, Section 9

” “Clause 3: No Bill of Attainder or ex post facto Law shall be passed.”

Explanation: A bill of attainder is a way that a legislature acts as a judge and jury, declaring that a person or group of people are guilty of a crime and stating the punishment. An ex post facto law criminalizes acts retroactively, allowing people to be prosecuted for acts that weren’t illegal at the time they did them. (https://www.thoughtco.com/constitution-article-i-section-9-3322344)

Impeachment Power cannot be used to try a private citizen who is no longer president

Any such trial would constitute a Bill of Attainder which is prohibited

Any order from such a trial would also appear to act as a retroactive law to apply to a previous action which was not illegal at the time it was said to have happened.President Trumps actions were legal at the time, and now cannot be made into a crime ex post facto.

An impeachment trial would be mere political theater. The purpose of such theater is to unify a disunified Democrat Party against the now vanquished enemy, Donald Trump who had provide unity via ginned up hatred provided by the press and Congress. The party needs a continuing bogey man to unify its standard Democrat base and its radical left wing.

It is a travesty that the Senate is even entertaining such folly. It will have no legal effect, no court would uphold the results of such a trial

They can now that there is nothing stopping them - they will soon realize that they can pass whatever law or regulation that pleases them, no matter how onerous or draconian.

Bills of Attainder? Why not? The Constitution means nothing to these power-drunk maggots
