No, the letter sounds like he is leaving it up to Congress, not kicking it back to the states.
He doesn't mention kicking it back to the states as an option at all. In fact the says he has no investigatory power.

After convening, each house has a vote. Neither the Senate or HOR will have a majority vote to disqualify any certified elector slate. Not sure how you thing this is good news.
Thinking there was a way to kick to states who are rising up as they reopen their legislatures but that option appears to have been snuffed.

This is why I think only extreme steps will really make a difference now.
We’ve seen how the courts approach this — they aren’t even curious. Won’t hear it. Don’t care.
The politicians even more so. The Democrats and the media want to win. Simple as that. Having a rational discussion and showing them proof is a waste of time.
Prediction: He will very briefly become President right before Biden’s term. I dunno. Maybe a day or two. POTUS will resign and receive a pardon from Pence pre-arranged or, less likely IMHO, will engage in a self-pardon unbeknownst in advance by Pence, and unceremoniously announce it on Twitter.
He has the authority because he is the last man standing who can act alone according to the Constitution. He is the Constitutional analogue to what one reaches in and grabs after following the ominous instructiobs to “Break Glass In Case of Emergency”. It is his duty to refuse to certify this “Explosion of B*l*s*i*” as his boss so eloquently and accurately referred to it to millions of American citizens a few minutes ago.
Evidently Mike Pence does not believe election fraud occurred. If he did believe this then he would be complicit in this fraud by certifying the EC count in favor of Joe Biden.
If Pence is the man of God he professes to be, he would do the right thing regardles.

No. If it goes contingent, each state gets a vote. It isn’t majority rule the way it normally is. More Rs than Ds.
