My God. If the VP gets to pick the President (basically that is what people are saying) merely by alleging fraud then that would invalidate the voters’ role in the process. A role that is presently paramount. Can’t even imagine the consequences of such a thing. This is stupid. Pense will do his ceremonial job. There will be objections and there will be debate (last chance for the KRACKEN!!!!!) but by tomorrow night Biden will be the pick. Yes, I know there was a lot of fraud but the writing is on the wall. The GOP knew for months about this mail-in scam and did nothing (little?) about it. We should’ve been printing up millions of our own ballots.

It’s my opinion you are correct. If you are not correct, in 2001 Gore could have simply thrown out the electoral votes in strategically selected swing states, declaring them fraudulent, to make himself the winner. Biden could have done the same in 2016 to make Hilary president. You could have objected that the votes WEREN’T fraudulent in 2001 and 2016, but on what legal grounds if you’re not going to require that some court or legislature has found them fraudulent before the Vice President makes that declaration? What’s disturbing is that President Trump doesn’t appear to have thought this through either.

That’s the problem with this “states rights” argument. According to them, if the State “certifies” it, then “constitutional conservatives” must accept it - no matter how fraudulent.

I continue to not see it that way.

This is a true Constitutional question. What is the role of the VP in the case of questionable slates of electors? No one really knows.

Executive Branch says "VP has power to decertify"
Legislative Branch says "No he doesn't. His role is ceremonial"

It has to go to the Supreme Court. There is no other way to break the tie between two co-equal branches of government.

Now, is the Supreme Court going to "select" the winner? No way. But they can throw it to the state legislatures because that's a very Constitutional path to a decision.

So under your 3 branch theory. If the house and Supreme Court disagree, the senate decides between them?

Not even close. See Obama administration. Most Republicans were afraid to even criticize him. Plenty of events that should have had a special counsel. Not a peep.

And if two sides are compromised? If SCOTUS turns on one compromised justice? If, under those circumstances, an illegitimate Executive is seated? I know that Jefferson envisioned occasional resets. Are the checks and balances too far out of balance? Is it time to blow the whole thing up?

it’s not willy nilly I want this person so I’ll choose them. Anyone thinking that is not very thorough with their thinking.

It’s hear objections, and decide based on real situation, evidence etc IMO.

It’s obvious the states certified without properly seeing outcome of elections in their states. It’s obvious some electors where chosen improperly according to states laws. It would be wrong of Pence to just bless those wrongs by saying I can’t do anything, we gotta let the fraud by which electors were chosen stand.

I think Dementia Biden is sworn in on the 20th regardless of what Pence does and his options are limited.

States make the decision on electors not Pence. What he does is formally accept them. If they fail to send him the electors by a certain date that’s another story but it appears they have all been sent.

Any state sending competing electoral college votes is irrelevant if one set is certified and signed by the Governor and the competing electors are not.

The fix is in but I’d like to see the resistance on the right be 100 fold what it was on the left for the next 4 years.
