In a video posted to YouTube on Monday, Turning Point USA founder and Republican activist Charlie Kirk explained the legal precedent for Vice President Mike Pence to reject state electors on Jan. 6, noting that similar powers have been invoked by Vice Presidents Thomas Jefferson and Richard Nixon. Kirk noted that during the 1960 presidential race between John Fitzgerald Kennedy and then-Vice President Richard Nixon, the state of Hawaii declared Nixon the victor and certified the results as such, prompting a challenge for recount by Kennedy.
Though Kennedy eventually won the recount, the state of Hawaii had already selected a slate of Republican electors, who sent their results to the Congress. Despite this, Nixon opted to use his plenary power in the Senate to reject the Republican election certificate and accept the Democrat certificate, in effect handing the state to his opponent.
Kirk stated that Nixon’s decision in 1960, despite angering legal scholars, ultimately proves that “the President of the Senate can do whatever he wants” and “there’s really no check and balance against Mike Pence on January 6.”
A similar precedent was also set in the election of 1800, Kirk noted, as presidential candidate Thomas Jefferson was currently the Vice President during a heavily contested election in the state of Georgia.
“Thomas Jefferson decided to put Georgia in his category despite the controversy, and Thomas Jefferson ended up becoming our third President,” Kirk said.
“So, Pence has what is called a ‘plenary power,’ which is a fancy legal way to say ‘absolute,'” Kirk continued, adding, “there’s precedent, there’s constitutional authority, Mike Pence’s power on January 6 will be plenary and unappealable. As President of the Senate, every objection comes directly to him, and he can rule any objection as out of order, accepted, denied, [or say] you get more...

Better be praying ALL out for God’s servant, VP Michael Pence.....
The only entity with plenary power in this whole affair seems to be the media. They have picked their President - and the GOP dares not object.
Kinda like chess pieces. The Queen having more abilities.
Pence will either be one of the great American heroes of all time, or a spineless coward that serves the deep state.
We’ll all know in two days.
Could it be overruled by Dems + 2 RINOs ?
Stuff and nonsense !
The man is just VP, not dictator.
I don’t believe that the presiding officer of the Senate has the super powers claimed by many. I will listen though as this chugs along.
I posted the case of 1872 regarding Arkansas and Louisiana yesterday
> Nixon opted to use his plenary power in the Senate to reject the Republican election certificate and accept the Democrat certificate <
The author makes it sound like Nixon had the power to accept or reject election certificates. Nixon only accepted the Democrat certificate because there were NO OBJECTIONS to that move.
Funny how the author omitted that key fact.
No, he doesn’t.
Congress does.
Camela Harris doesn’t have this power, nor does Mike Pence.
Nixon merely corrected things based on a normal recount.
Georgia in particular has been egregious and must decertify immediately...
And there are NO certified alternate slated.
So it will be over quick.

What time does THIS part of the Rodeo begin ? Anybody ?
Mike Pence has never colored outside the establishment lines in his life.
There are more than 100 GOP "no" votes in the House and at least 30 GOP "noes" in the Senate.
"2 RINOs" could defeat this, yes, but getting rid of Trump is a mainstream GOP objective.
There is zero chance of that happening.
They aren't that bright, they really don't work for the voters, and they are drunk on power and attention.
Once in a great while a true statesman comes along and changes history, like Trump. But most don't have the courage to do the right thing and change history for the better.
