I think that’s a good idea. If they’ve tossed it back to the states, then it’s up to the states to assert their rights.
If all states which joined Texas in the SCOTUS suit abstained, the remaining states probably still have 270+ votes. At least 2 out of PA, MI, WI, GA & AZ need to be stopped. And none of them joined Texas.
