Judge Emmet Sullivan still refusing to dismiss Michael Flynn case
More than a week after Flynn was pardoned by President Trump, Judge Sullivan still won't dismiss the case

n a Freedom of Information case related to former National Security Adviser Michael Flynn, District Judge Reggie Walton said on Friday that Judge Emmet Sullivan doesn’t have a lot of options in dealing with the fact that President Trump granted Flynn a full pardon, “unless he takes the position that the wording of the pardon is too broad, in that it provides protections beyond the date of the pardon.”

“I don’t know what impact that would have, what decision he would make, if he makes that determination that the pardon of Mr. Flynn is for a period that the law does not permit,” said Walton, according to the National Law Journal. “I don’t know if that’s correct or not,” the judge continued. “Theoretically, the decision could be reached because the wording in the pardon seems to be very, very broad. It could be construed, I think, as extending protections against criminal prosecutions after the date the pardon was issued. I don’t know if Judge Sullivan will make that determination or not,” Walton added.

The legal process has dragged on through the appeals process, and finally President Trump issued a full pardon on November 25. On November 30, the DOJ notified Sullivan of the pardon, but he has still refused to drop the case.

Judge Walton appears to have hinted at what Sullivan is thinking as he refuses to dismiss the case.

Solomon Wisenberg, former deputy independent counsel, told Just the News that “It is disappointing but not surprising that Sullivan has yet to dismiss the case.”

Send the US Marshalls to arrest Sullivan for obstruction of justice and for denial of civil rights under color of law.

10-20 at GITMO should be a good sentence for Sullivan’s crimes.

This judge reminds me of another one who a while back sued a dry cleaner in DC for a million Dollars because he misplaced his suit. Some people just are in the wrong profession.

Yes, my screen name is related to the 55th Massachusetts Infantry. I researched the unit for many years, tracked down descendants of the men in the unit, and assisted getting one the Medal of Honor. Made many trips to the James Island area of S.C., and walked in the footsteps of the men who fought and died there. No, I don’t live in Massachusetts. I’m a 73 year old, retired New York State Correctional Sergeant, a mother of two grown sons I raised alone. I have been on FR for 23 years. What’s your claim to fame besides liking to tell other people how they should live their lives?

Of course I did, in November, just like pretty much every other Republican in Texas.

I would have liked to vote for someone else in the primary, but he didn’t have a serious opponent.

Even assuming Flynn Pardon covers past and future conduct, in the case before Judge Sullivan, Flynn is charged for past conduct and the Pardon is clearly acceptable in scope and Flynn case unquestionably should be dismissed. Walton's theoretical issues with the Flynn Pardon are potentially relevant if Flynn uses it to defend against future charges for past or future conduct.

Does the judge think he can override the Constitution?

The answer is "yes". Under a Biden DOJ, pardons from Trump will be deemed as unauthorized, and the ones with them will have to fight in the courts to try to make them good. Pack the SCOTUS and there will be enough liberal judges to invalidate the pardons.

When I happen to watch Court Cam on TV, I will very occasionally see judges that are almost drunk with power. In one case, the judge was actually brought before a panel of judges and reprimanded for her behavior. I don’t understand why this hasn’t happened to Judge Sullivan. Do judges at his level have no oversight whatsoever?

I read your initial post and replied to it. Did not tell you how to live your life. Being an old fashioned sort who is older than you I have a problem with respecting women who swear like the proverbial sailor.

As for my contribution? I served in the military. USAF Law Enforcement and OSI.

When Republicans take the House in ‘22,

If we lose this election to Biden there won't be a chance in He77 of wining back the House, even if we could there would be even less chance that the Senate would convict and in the mean time General Flynn will be in jail.

If Sullivan orders Flynn and his attorneys to show up for a hearing and they don't come, could he ordered them jailed for contempt of court?

Before the election it seemed that his purpose was to make sure that Flynn could not serve in the Trump administration. Now that he thinks Biden will become the next President it's hard to tell what his motivation is--just a personal obsession? Or is he following orders?
