Sidney Powell’s Election Lawsuit in Georgia Gets Expedited Appeal

A federal appeals court agreed on Wednesday to expedite the appeal in a case brought by lawyer Sidney Powell against election officials in Georgia.

A judge on Sunday blocked election officials from wiping or altering Dominion Voting Systems machines in three counties, but Powell was seeking a statewide order, prompting her to seek an emergency appeal from the U.S. Court of Appeals for the Eleventh Circuit.

The appeals court on Dec. 2 granted the emergency appeal, ordering plaintiffs to file their initial brief by midnight and defendants to file their response by midnight on Dec. 4. Plaintiffs can file a response to the response by midnight on Dec. 6.

The initial brief wasn’t listed on the docket as of early Thursday. Plaintiffs later filed two affidavits and an expert report from Matthew Braynard.

Also on Wednesday night, the Democratic Party of Georgia entered an emergency request to grant an intervention so they can participate in the appeal. The party is being represented by Washington firm Perkins Coie, a longtime Democrat-linked company. The request was granted on Thursday.

Powell is representing about a dozen voters who argue there was a fraudulent scheme to manipulate the vote count to make sure Democratic presidential candidate Joe Biden won Georgia.

Powell is seeking to have outside experts examine Dominion machines. Georgia election officials are attempting to prevent that from happening.

The case is Pearson v. Kemp, 1:20-cv-04809.

Why were all the problems caused by Dominion in swing states?
When Dominion wasn’t use, there were no problems.

Not at all; she shot herself in the foot.

The trial judge let her examine Dominion machines in 3 counties, and was then going to have an evidentiary hearing on December 4 (tomorrow). By filing an appeal, Powell put all of that off indefinitely.

What's worse, the order is probably not even appealable; in the order setting the expedited schedule, the Court of Appeals asked both sides to brief that issue (appealability) along with the merits. So, worst case, the 11th Circuit dismisses her appeal (or hears the merits and affirms); best case, it says she can examine more counties, but sends the case back down to the trial court to set a new schedule. Either way, she is going to run the serious risk that nothing will be decided before the electors meet on December 12, at which point the case is likely moot.

I fear inspecting the machines at this point might blow up in her face. I seriously doubt that if the machines had fraudulent code in them on election day/night that the same code is in there now. The "wiping" was done long ago.

What I said about the court rulings is a matter of public record, and I can post the court orders if you want: the trial judge did schedule an evidentiary hearing for tomorrow; he did cancel it after Powell filed her appeal; the Court of Appeals did ask the parties to address whether the order is appealable.

How that plays out is, of course, conjecture, because it hasn't happened yet. But it's conjecture informed by my 41 years of legal experience. YMMV.

The surveillance video that came out today is devastating to anyone who is trying to cover up this stolen election. There need to be arrests on this alone.

Why on earth would Georgia election officials want to stop the examination of Dominion machines? Would they not want someone to verify their assurance of the accuracy and honesty of the machines? It would greatly enhance their overall political credibility.

It "played out" exactly as I said it would: the 11th Circuit, in an opinion by a Trump-appointed judge, dismissed Sidney Powell's appeal, and expressed bewilderment as to why she would have appealed an order in her favor. The result is that the evidentiary hearing she was scheduled to have today (with examination of Dominion machines in 3 counties) will now have to be re-scheduled, and in all likelihood won't be completed before the safe-harbor deadline. This woman is starting to make Orly Taitz look like a competent lawyer.
