In my opinion, Republicans should start impeaching any and all judges that they can. It should become a normal thing for dozens of judges to be impeached each year.
Before you call me nuts and tell me that would break tradition and it is not how judges are supposed to be treated....think about this....
We have one party that says, “we just want our judges to FOLLOW THE LAW”. They don’t want activism. They don’t want legislating from the bench. Just read what the law says and implement it. Both liberal justices (when it suits their needs) and conservative justices can do that. If a judge says, “the law says X so my judgement is X” you can’t necessarily tell if they are liberal or conservative.
On the other hand, the one party says... “the Constitution is a living breathing document and needs to be interpreted in different ways depending on the situation” These people are only liberals. You can spot a liberal judge immediately if they use this type of justification in their ruling.
We need to get to the point where judges are TERRIFIED to make their political ideologies evident. In such an environment, judges will be far more likely to say “Sorry, my hands are tied. The law is the law” and make judgements based solely on the existing law. In a world where judges were picked off left and right by partisans, you will see far more judgements based on existing law only and far fewer based on political interpretation of law which reveal their biases.
See the name.
Thanks, I got sloppy in my excitement.
We have current two open positions at the circuit level and one future opening to fill for 11/30
01 - CCA Torruella,Juan R.
07 - CCA Barrett,Amy Coney
07 - CCA Flaum,Joel M. Going Senior 11/30/2020
None of these has an official nominee yet but I read that if nominations are made in the next week or two Mitch says he can get them confirmed before January 19th.
A nomination has been announced on October 21, 2020 for the 7th Circuit:
Thomas L. Kirsch II, of Indiana, to serve as Circuit Judge on the United States Court of Appeals for the Seventh Circuit, but this nomination has not been formally presented yet and is not listed on US Courts.gov
Only when it suits them...................
Do it! Get them in there new positions ASAP.
