Judicial Watch President Tom Fitton said the expansion of mail voting made the election chaos "entirely predictable," extending the vote count past Election Day, which is illegal.
President Trump was ahead on Election Day and therefore should be declared the winner, he insisted in an interview with Fox Business host Lou Dobbs.
Fitton, who recalled testifying before Congress that "this vote-by-mail scheme was going to lead to chaos," argued federal law requires that states "shall select select their electors for president and vice president on Tuesday, Election Day, and it hasn't happened."
"No one's been in court to enforce that law," he said. Instead we have the (Trump) campaign, arguing for a better seat to watch the three-card monte game in which they are the mark.
"They're not going to win," he said.
Fitton said that the five or six states counting ballots after the election "necessarily suggests something unproper is going on."

Jim Jordan just said something similar on Hannity, based on apparent similar comments from Mark Levin.
Fitton is suggesting a different legal strategy than the one they’re currently on.
I wish Fitton was involved. They should hire him.
All the SCOTUS has to do is to rule that no votes can be legally accepted past the closing of the polls. Bada Boom! Bada Bing!

This legal angle appears to be all about counting. That per the US Constitution the counting must all be complete by election day. Therefore, any votes counted after 11:59 PM on election day would be invalid.
If you carefully look at some of Trump’s recent statements, he actually seems to be saying this.
Trump’s fighting this totally fraudulent election. We need to protest! Go to your state capitals tomorrow.
People are coming forward with verified evidence of fraud. They need our support because they are risking being targeted by the left. Anyone with any proof of fraud will be rewarded.

I agree. However, the next step will be trying to figure out when each ballot was received. Dems will try to game that number, of course, by claiming that all but perhaps a few came in before the deadline, but we already have affidavits from election employees testifying that everyone was ordered to backdate ballots that came in after the deadline.
I’m starting to feel at least a little more confident.
This is applicable to local districts/wards with relatively small numbers of voters. They can then transfer the physical ballots to a central location with a Chain of Custody.
I don't know how strong that argument is. Here's the language of Article II, Section 1, Clause 4:
The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.
I believe this means the Electors (i.e., the Electoral College) must cast their ballots to elect the President on the same day -- which I believe is around December 14th this year. It says nothing about Election Day itself.
If anyone ever gives this idiot a penny they deserve to lose it.
I'll bet that in the last 70 years not one single state has officially certified their vote on election day.

Thanks AC. You are correct per usual. However, the electors certainly have not yet been chosen. An assumption could easily be made that past president meant that this technicality shouldn't be enforced. However, if he could potentially prove that there are significant errors with the various batches (mostly mail-in) that hadn't been counted yet, by end of election day, he might get some traction.

How long would it take a handful of fraudsters to “hand stamp” a date code on each ballet to somehow prove it was received by the deadline? Talking about millions of ballots - not more than a few tens of thousands.

Jim Jordan was on, and mentioned Levin several times though, in the context “day of election votes” best I can remember.
I’ll need to review that tape, as well as check out the repeat of Levin’s show tonight. Hope I’m not too far off course.
