If you’ve been following the mainstream media, you’ve probably read that Trump intends to file a lawsuit in Pennsylvania to “stop counting votes.” Most likely, this has been presented as an outrageous evil, unjustifiable by any standards of common decency, and grossly unconstitutional. Is that really the case?

In 2019, the PA legislature passed a law called Act 77 that permitted all voters to cast their ballots by mail but (in Justice Alito’s words) “unambiguously required that all mailed ballots be received by 8 p.m. on election day.” The exact text is 2019 Pa. Leg. Serv. Act 2019-77, which stated: “No absentee ballot under this subsection shall be counted which is received in the office of the county board of elections later than eight o'clock P.M. on the day of the primary or election.” I agree with Justice Alito: That is unambiguous.
Act 77 also provided that if this portion of the law was invalidated, that much of the rest of Act 77, including its liberalization of mail-in voting, would also be void. The exact text is: “Sections 1, 2, 3, 3.2, 4, 5, 5.1, 6, 7, 8, 9 and 12 of this act are nonseverable. If any provision of this act or its application to any person or circumstance is held invalid, the remaining provisions or applications of this act are void.”

The Pennsylvania Supreme Court didn’t just say “Act 77 is unconstitutional.” It re-wrote Act 77 itself, by judicial fiat, creating new rules for time, place, and manner, of holding elections. In doing so, the State Supreme Court violated the US Federal Constitution.

I really wonder if there is any way that the late ballots can actually be identified. One would think there would be a time stamp of some sort but I’ve heard nothing on this subject that would be encouraging. And I’m personally doubtful that these ballots can still be separated out.

True. And I am very concerned about trusting the SC on any issue where the States are concerned. If Biden is called President Elect, the SC is going to be very hesitant to undo that.

You’re assuming that our side will write the history. The way the USA, and the World, is changing suggests the winners in the end will be the other side eventually.

Very difficult to clean out the deep state when you are being harassed by it for 4 years. This is not Trump’s fault but the GOP leadership who is willing to give up the Presidency thinking it can still control the GOP afterward.
The left is hard at work, loosening the bonds of law and custom.
How do we know what ballots arrived at what time?
yes, they can be identified...they were late! I really think they’ll certify by how many Trump had at 8pm
Most of them keep their “job” regardless...or they get some other cushy government job no matter.
No matter..they will enjoy their mansion(s) and their perks for the rest of their lives.

Trump won this election in a landslide and deserved another 4 years, but he, NOT the deep state, is the boss of Barr and Wray. Where are they? Where’s Donald Trump’s DOJ? Where has the DOJ been?
No doubt that the DOJ has been a major disappointment to Trump and if he wins a second term, he will get rid of Barr. Wray will be gone as well. But for four years he has faced every kind of hostility possible. The deep State is very, very deep and powerful, as we see in this election being stolen. A man can only do so much by himself.

Arnon Milchan is Fox’s election guru who makes these election night calls, is a big lib, and he’s been doing it for decades. Rush said that in 2000 Roger Ailes ran Fox News. He told someone in an interview that all during the time returns were coming in at Fox during elections, Milchan was in constant touch with his RAT cohorts.
