A LOT has to happen first before it gets to this step and, even if it does, do the Dems REALLY believe Justice Roberts or the new justice will let the Dems get away with this? If conservatives have (on paper) a 6-3 majority, wouldn't it take two conservative justices to give the election to Biden? My prayer is that Trump will have beyond 300 EVs on Election Night. Maybe one state gets eventually flipped after Election Night, but two or more would be highly irregular and would certainly raise suspicions. In fact, if I were Trump (or Kayleigh), I would raise the data of how few states change hands after Election Night and how multiple states changing would be highly irregular and most suspicious. The further ahead Trump is by 2 a.m. on November 4th, the harder it will be for Dems to steal the election without it being obvious to everyone what is happening.
