‘Fill the seat’: Will Chamberlain notes that Amy Coney Barrett has already gone through Senate confirmation hearings

We’d like to see the Senate seat President Trump’s nominee to replace Justice Ruth Bader Ginsburg as quickly as possible — it could have even longer-lasting implications than a Harris-Biden administration would, as there would be a check on their power in the Judicial branch.

We’re not sure who the nominee will be, but Judge Amy Coney Barrett has been on the short-list for a Supreme Court seat for a while, and Human Events editor-in-chief Will Chamberlin reminds us that Barrett already went through Senate confirmation hearings in 2017 when she was named to the Seventh Circuit Court of Appeals. The Senate confirmed her then, so why not let those be the hearings and just have a vote?

Maine Republican Sen. Susan Collins says the nomination of a Supreme Court justice to fill the vacancy left by the death of Ruth Bader Ginsburg should be made by whichever candidate wins the presidential election.
Citing the proximity to Election Day — now just weeks away — she said in a statement Saturday: “In fairness to the American people, who will either be re-electing the President or selecting a new one, the decision on a lifetime appointment to the Supreme Court should be made by the President who is elected on November 3rd.”

Janice Rogers Brown, appointed to the US Court of Appeals in DC by George W. Bush, but she is in her 70s so that probably puts her out of the running.

AutoZone, in which the federal government asked the full court of appeals to reconsider a ruling against the EEOC in its lawsuit against AutoZone, an auto parts store. The EEOC had argued that the store violated Title VII of the Civil Rights Act, which bars employees from segregating or classifying employees based on race, when it used race as a determining factor in assigning employees to different stores – for example, sending African-American employees to stores in heavily African-American neighborhoods. A three-judge panel (that did not include Barrett) ruled for AutoZone; Barrett joined four of her colleagues in voting to deny rehearing by the full court of appeals."

Technically, at least per the Constitution, I don’t think there are any requirements.

I believe all the requirements that are currently imposed are all based solely on tradition.

We had an excellent African American female conservative judge on the DC Circuit, Janice Rogers Brown. She was a W appointee. She retired from the bench at age 69 and did not take senior status.

She needs to read up on SCOTUS nominations in presidential election years of past presidents.
There have been 29 Supreme Court vacancies in election years in the history of this country, the sitting president has nominated someone to fill the position 29 times out of 29, including one case when the president that was leaving office actually made a nomination literally on his last day in office.
However, she is fighting for her political life in the upcoming November elections in a somewhat liberal state.
