Cruz: Trump should nominate a Supreme Court justice next week

Sen. Ted Cruz (R-Texas) said President Trump should nominate a Supreme Court justice to replace the late Justice Ruth Bader Ginsburg on the high court next week.

"We have a responsibility to do our job," Cruz told Fox News's Sean Hannity on Friday evening. "We cannot let Election Day come and go and with a 4-4 court ... we risk a constitutional crisis. I believe that the president next week should nominate a successor to the court ... and I think that it is critical that the Senate takes up and confirms that successor."

Cruz added that there would be "enormous pressure from the media" and Democrats to delay filling the vacancies Ginsburg's death has created, but said "this nomination is why Donald Trump was elected and this confirmation is why the voters voted for a Republican majority in the Senate."

The Senator from Texas added that Trump should nominate a "constitutionalist with a proven record."

Cruz, a graduate of Harvard Law School and one of Trump's staunchest allies on Capitol Hill, was on a short list of candidates Trump released last week as potential Supreme Court justices.

Ginsburg, one of the court's more liberal justices, died of pancreatic cancer on Friday at the age of 87.

"She just died? Wow. I didn't know that. You're telling me know for the first time. She led an amazing life. What else can you say?" Trump said when asked by reporters about Ginsburg's death following his campaign rally in Minnesota. "She was an amazing woman. Whether you agreed or not, she was an amazing woman who led an amazing life."

Senate Majority Leader Mitch McConnell (R-Ky.), opposed former President Obama's nomination of Merrick Garland to the court in 2016, said the upper chamber would hold a vote on a potential Trump nominee before the November election.

Then I guess we disagree.

I think her fate is sealed. Maine voters won't be that fickle that they hate her now but will switch if she votes against.

Look at the recent NYT/Siena poll:

  1. Independents prefer Gideon 50-42. Independents make up 42% of the poll sample.
  2. Gideon's favorable/unfavorable is 55/40. Collins' is 50/47.
    • Among Independents, Gideon is 58/36 and Collins is 48/51.
    • Among Independents, Brett Kavanaugh is 25/49, so I don't think Collins will recover from that vote.
    • Among Independents, Black Lives Matter is 64/29, so Maine has clearly moved away from Collins' leanings.
  3. On the question "Who will do better choosing a Supreme Court Justice," Independents chose Biden over Trump 68/28. Those people won't change their minds on Collins no matter how she votes. They want the Democrat.
  4. On the question "Do you prefer Democrat or Republican control of the Senate," Independents chose Democrats 58/34. Collins is gone no matter what she does.

At this point, Collins should be thinking about legacy. I hope she doesn't want to be compared to John McCain, whose lasting legacy is voting down Obamacare repeal just to spite President Trump, Americans be damned.

Collins should take the high road and vote to secure the leaning of the Supreme Court for the next three decades.

Politicians always think they have a shot and she will see this as her brass ring. She based her entire on bucking the Republican Party.

No, they don't. They decline to run for re-election, just like all those Republicans in the House did in 2018.

Collins may have thought she "had a shot" when she started and before her opponent won her primary, but she's got to see the writing on the wall by now.

Let's see what next week's polling brings, now that Ginsburg has passed.

President Trump should offer her a deal, maybe Ambassador to Canada if she votes to confirm since she's going to lose anyway.
