Portland protester's charges dropped under new district attorney's policy

PORTLAND, Ore. — Earlier this month, Multnomah County's new District Attorney Mike Schmidt announced a new policy saying his office would not prosecute many of those arrested while demonstrating in Portland.

The policy states they will not prosecute unless there is deliberate property damage, theft, or threat of force against another person.

For the last two months, numerous protesters like Berkeley Franklin were awaiting their arraignment.

Franklin says they, along with other protesters, were in downtown Portland at a protest in early June walking away from police with hands raised when taken into custody.

"I wouldn’t necessarily say that I was being disruptive in any way personally. I was in an area, they didn’t want me in an area," Franklin said.

Franklin said they didn't know what the charge was until being released from custody.

"They put me in solitary confinement for five hours without telling me why, and took away my inhaler, and charged us with interfering with a peace officer," Franklin said.

Multnomah County District Attorney Mike Schmidt said on August 11 he will not prosecute for disorderly conduct, criminal trespass, or in cases of interfering with a police officer.

KATU spoke with some attorneys who don't support this policy.

What a libtard idiot. He should be out rioting with his homies, not putting on a suit and tie and prancing around in the DA’s office. He’s just given these evil, obnoxious, commie traitors a big green light on continuing having their way, unfettered, with the city. How do they find these people? He’s the stuff you scrape off the bottom of your shoes on the curb.

Mayhem transpires for hours. The police step in and all
those folks out there the whole time plead innocence.

And now the DA sides with them over the officers.

That’s why the Oregon State Police withdrew.

No sense in arresting if no one will prosecute.

The PDX Mayor, City Council, and Oregon state officials threw fits that federal agents had to defend federal buildings. They wanted the feds out so rioters would have free rein on destroying federal property.

Member of the Trump Administration said hell no. Then the protesters started to increase the confrontation and the City officials because desperate to have the federal agents leave or at least step down and hid in the shadows. The Portland officials would not allow the Portland police to do what was necessary to protect federal property.

Finally a compromised was reached. The Oregon State Patrol agreed to come in and protect federal property by helping the Portland police. That allowed the Federal government to be assured that their property would be protected.

Well, the local D.A. decided that those arrested on most rioting charges, even those arrested by the Oregon State Patrol would not be tried and have their charges dropped.

The Oregon State Patrol, told Portland, they were withdrawing and not going to play such a silly game.

Now the protesters are again taking aim at federal property. It will be just a few days until Trump sends in federal offices in large number to put a stop to this nonsense. When that happens who is going to save the Portland elected officials from themselves and their failed promises?

Reminded how in Chicago, a number of Alderman are asking for a resolution to request the Governor of that state send in the National Guard to augment police and restore peach and order.
