SACRAMENTO, Calif. (AP) A three-judge panel of the 9th U.S. Circuit Court of Appeals on Friday threw out Californias ban on high-capacity ammunition magazines, saying the law violates the U.S. Constitutions protection of the right to bear firearms.
Even well-intentioned laws must pass constitutional muster, appellate Judge Kenneth Lee wrote for the panels majority. Californias ban on magazines holding more than 10 bullets strikes at the core of the Second Amendment the right to armed self-defense.
He noted that California passed the law in the wake of heart-wrenching and highly publicized mass shootings, but said that isnt enough to justify a ban whose scope is so sweeping that half of all magazines in America are now unlawful to own in California.

Same here. I can’t get them shipped in though. I’ve got all kinds of magazines but I’d love to get my hands on Vietnam era 20 rounders for an SPR.
This also happened a couple of years ago when a judge put on hold the magazine law. As a result, magazine makers flooded Cali with hi-cap magazines for a few weeks.

Well, well nothing.
This is going to an en banc panel, where it will get slapped down. Then SCOTUS will decline to review, and the en banc ruling will stand.
Actually, the 2nd makes no reference to self-defense though it is implied. It is not the “core” of the 2nd. The introductory portion regarding the well ordered militia indicates the primary purpose, the “core” of the Amendment.

Will be interesting to see if Becera tries to appeal to SCOTUS, or if he asks for an En Banc hearing of the 9th circus.
In the interim, here’s hoping that the stay is lifted and people can again enjoy an enumerated right, even in California.

And while all this is going on they are laughing their asses off because they have made it almost impossible for anyone in California to buy ammunition to put in those magazines...........legally.
I hope NY is also in the mix.
Hell i’ve always been in the mix, don’t have a single mag under 20 capacity.
