CDC: Some people with certain medical conditions, like asthma, do not have to wear masks.

Just tell them you have asthma. If a store still does not let you in, they have violated the Americans with Disabilities Act (ADA) and you can sue them. If a business follows SOME CDC rules, they must follow ALL of them or risk a lawsuit.

Once Trump says “masks are cool”...all of the sudden there’s carve outs for those that don’t need to wear masks.

Nobody has to wear face masks unless they want to. It’s not about health. It’s about control.
They don’t work. They have never worked. And they are bad for your health.
Mass non compliance by freedom loving constitutionalists is called for.
I’ll never wear em.

If the “mask enforcers” even ask you why, they are violating the HIPPA act and the 14th Amendment, violating your “right to privacy!”

Unfortunately It’s more complicated than that. The ADA has exceptions. The one that they are relying on is this:

III-3.8000 Direct threat. A public accommodation may exclude an individual with a disability from participation in an activity, if that individual’s participation would result in a direct threat to the health or safety of others. The public accommodation must determine that there is a significant risk to others that cannot be eliminated or reduced to an acceptable level by reasonable modifications to the public accommodation’s policies, practices, or procedures or by the provision of appropriate auxiliary aids or services. The determination that a person poses a direct threat to the health or safety of others may not be based on generalizations or stereotypes about the effects of a particular disability; it must be based on an individual assessment that considers the particular activity and the actual abilities and disabilities of the individual.

The individual assessment must be based on reasonable judgment that relies on current medical evidence, or on the best available objective evidence, to determine —

1) The nature, duration, and severity of the risk;

2) The probability that the potential injury will actually occur; and

3) Whether reasonable modifications of policies, practices, or procedures will mitigate or eliminate the risk.

Such an inquiry is essential to protect individuals with disabilities from discrimination based on prejudice, stereotypes, or unfounded fear, while giving appropriate weight to legitimate concerns, such as the need to avoid exposing others to significant health and safety risks. Making this assessment will not usually require the services of a physician. Sources for medical knowledge include public health authorities, such as the U.S. Public Health Service, the Centers for Disease Control, and the National Institutes of Health, including the National Institute of Mental Health.

ILLUSTRATION: Refusal to admit an individual to a restaurant because he or she is infected with HIV would be a violation, because the HIV virus cannot be transmitted through casual contact, such as that among restaurant patrons.

The “law” has been weaponized. It will be read and molded by the elite to do whatever they want the “law”’to do.

HIV gets all sort of ADA protections because of queers. COVID will not because of Democrats.

Nice rant, but if you file a lawsuit in this case you better have the asthma to back it up.

HIPAA lacks a private right of action. Only the Department of Health and Human Services and state attorneys general have the power to enforce HIPAA violations. Moreover HIPPA doesn’t even apply to non-covered entities.

The 4th Amendment requires governmental action and doesn’t protect against private action.

Again, the “law” has been weaponized. You have zero legal recourse. It will be molded to do what the elite want. Couple this with the Soros DAs criminalizing self defense and legislatures going after the 2nd Amendment without any pushback from the courts.

It’s time to stop thinking like lawyers and start thinking like patriots.

There’s a good chance that most businesses that rely on that statutory exception are likely to lose any legal challenges over it. The last thing any business owner wants to do is fight a legal battle that is predicated on the effectiveness of a stupid mask.

I have had pleurisy and my lungs are still not right 11 yrs later. I will be DAMNED if I share that info with anyone. It is very private and I am not going to justify my not wearing a mask with ANYONE.

I did let someone know at Lowes, who was helping me, and he confided that he had asthma and Diabetes and was having health issues as a result of the mask he is required to wear. From just wearing the mask there for abut 20 min, I was out of breath and had to be helped to my car.

The ADA says the store has to make reasonable accommodations. Curb side delivery for example.

Me,too...ref. mask causing shortness of breath and inability to catch it again. I wear my mask with my nose free of mask...the mask just covers my mouth. I have had asthma with exacerbations for years and years. I always carry an inhaler... and with fewer and fewer people smoking I have had less and less cause to use it. I thank God.

I nearly threw down with the mask nazis at Walmart.

One of them said she had asthma and wears a masks and I said “Then you don’t have it bad enough”.

Pushed past them and went for a manager.

We both went in bare faced.

Sick of this phony shit.

I haven not bitten anyone [yet] so I don’t need a damn muzzle.

Yup. Might not be any blowback of consequence from not wearing the mask, but perjury will get you in some bigtime trouble quick.

I have ROBLS, (Reduced Oxygen Blood Level Syndrome). It is a condition that is mostly unknown to the individual. This occurs when wearing a mask, the individuals blood 02 level drops below 90. Try ROBLS. It works for me every time. Always use the ACRONYM when describing the syndrome. It makes the store personnel actually believe you know what you are talking about. Create a great mask free day!
