Judge asks full federal appeals court to reconsider decision forcing him to drop Michael Flynn case

The judge in Michael Flynn’s criminal case asked a federal appeals court Thursday to reconsider its ruling last month ordering him to dismiss the prosecution of the former national security advisor to President Donald Trump.

Judge Emmet Sullivan’s lawyer asked for a so-called en banc review of the decision of the appeals court, which would involve all active judges on the court to re-hear the case.

The preferred goal of the conspirators and their supporters is to force Trump to pardon Flynn thereby allowing them to attack Trump as corruptly pardoning his friends.

He’s been canvassing them, and knows what the answer will be.

He might have had some insiders put out feelers, but he wouldn't make direct contact. I suspect he was hoping a judge on the DC Circuit would do it for him. I'm somewhat surprised one of them didn't, and that doesn't fare well for Sullivan. I don't think the court wants this case, as they would have to do some serious twisting of their own recent precedents to overrule the panel. But if they do review the case en banc, they will do exactly that.

The panel’s order was based on a recent SCOTUS decision and was pretty clear that there is no remedy. They’re going to have to engage in massive amounts of pretzel logic to grant this.

Wouldn’t be the first time though.
