The federal judge who has continued the prosecution of Michael Flynn despite the Justice Department's motion to drop the case has halted scheduled hearings.
The Washington Examiner reports Judge Emmet Sullivan issued an order late Wednesday after an appeals court sided with the DOJ's request.
Flynn, a retired lieutenant general, briefly served as President Trump's national security adviser.
He withdrew his plea of guilty to the charge of lying to FBI agents in special counsel Robert Mueller's Russia collusion investigation, claiming he was the victim of a "perjury trap."
Evidence recently unsealed in the case confirmed his claim, showing FBI agents -- after the bureau was prepared to close the investigation for lack of evidence -- discussing how to get him to lie.
The Justice Department moved to drop the charges, but Sullivan refused to sign off on the motion. Instead, he appointed a retired judge to argue against the DOJ.
Now he's pressed pause on the case.

The judge is a party in that the proceeding is not an appeal but a petition for an extraordinary writ. Thus the judge was accorded the opportunity to file a brief as a named party.

My take is the dropping of charges releases the gag orders placed on Flynn. Should his BOOK and testimony get out before the elections the Demoncrats will have to take another torpedo...I already believe they are sunk, but we need to keep up the fire.
I really, really hope Flynn is waiting to submit his already written book to publishers.
Even Sydney Powell said that in an interview I watched (with Dan Bongino, on YouTube). She said she'd been before Judge Sullivan on other cases, and thought he was a fair judge.
I believe you do not need to blackmail those that think government is the answer to every question. Those in government join because they believe. They also understand that Trump is an Imminent threat to their world and thus must be defeated no matter how!
Our Company lawyer thinks Sullivan will declare a mis-trial to force the Flynn team to jump through more hoops. One of the talk shows said yesterday that this could be going until the end of the year.

Maybe it is time for an impeachment of a federal judge? Or a censure of the judge by his superiors in the Court.
The goal is to keep it going. An appeal to the full court and then, if necessary, appeal to Supreme Court takes us into the middle of next year.
I don’t think he can declare a mistrial because DOJ wants it dismissed with prejudice. Anyway, a mistrial gets Sullivan off the case and they have to start all over again.

Me too! They had to repeat the entire history of the Flynn Case just so they would have an actual article as opposed to a sentence.
Also when they say ‘read more at source’ and there is nothing more than a couple of words.

The DOJ should then indicate that they would be no retrial of the case the case, announce that Flynn is completely innocent, and instead proceed to prosecution of those who suppressed evidence and perjured themselves at any point in the conduct of this case.
If Sullivan declares a mistrial, wouldn’t he be openly defying the Appeals Court which ordered him to dismiss? What does your company attorney say about that?
They read very differently.
