The lawsuit may not prevail but it is definitely worth the effort.

If they have really sharp attorneys they may find some way to throw something at the wall and make it stick—laws these days are _very_ complex.

The litigation is demanding compensation—for damage done—it is irrelevant whether the damage continues to be done.
