It is highly likely that the defense will prevail, notwithstanding the best efforts of Sullivan to turn the law upside down. But it's a evenly divided court so getting two or three Pub judges to rule in Flynn's favor will be the luck of the draw.

The DOJ dropped the charges, so the judge literally has no case to preside over. Sullivan is trying to force Trump to pardon him before he is cleared by the legal system and perhaps fix it where Flynn can’t sue anyone, including his punk ass.

But wait. On Tuesday, Flynns attorneys resorted to a higher court for relief by filing a writ of mandamus before the U.S. Court of Appeals for the District of Columbia Circuit. They correctly argue that Sullivan should be kicked off the case and/or ordered to follow the law by dismissing the criminal charge against Flynn.It seems straightforward and obvious. But my faith in the justice system is a little shaky right now.
It is highly likely that the defense will prevail, notwithstanding the best efforts of Sullivan to turn the law upside down. This is because the trial court judge has no authority whatsoever to usurp the power of the Department of Justice (DOJ), which uncovered the exculpatory evidence of Flynns innocence and decided to drop the case entirely.
Well, let's hope so. Justice delayed is justice denied.
