Yost Argues for Separation of Power, Leads Coalition Supporting Dismissal of Case Against Gen. Flynn

Ohio Attorney General Dave Yost today led a coalition of 15 attorneys general from around the country in filing a brief to the United States District Court for the District of Columbia supporting the federal government’s motion to dismiss the case against Gen. Michael Flynn.

After the federal government decided not to pursue criminal charges against Gen. Flynn, the U.S. District Court for D.C. implied that it may order the prosecution to continue through a court-appointed prosecutor. The district court additionally stated that it would invite other individuals and organizations to file amicus briefs addressing whether the court should grant the government’s motion to dismiss.

“This extraordinary example of judicial activism is the antithesis of our Constitution and the separation of powers,” Yost said. “Our founding fathers designed a system of government precisely to stop a branch of government from undertaking this type of overreach.”...

I thought all that was left for this judge to do is pass sentence. Why would he need another prosecutor to do that?

I think Mark Levin called for petitioning the Court of Appeals to issue a WRIT OF PROHIBITION to this vainglorious out-of-control Judge.

Thomas Jefferson foresaw the possibility of a time when the Republic might fail due to a tyranny of the judges. It would seem that that time has arrived, especially the last three years +.

Most of the states joining the suit are from the south. Not a one from the northeast, and only UT and AK from the west.

It’s good that multiple state AGs are getting on board. It doesn’t matter where they come from, just that they are taking a very public stand on the legal rules.
