Good question. Probably because he has a bug up his butt is now too emotionally involved to be rational.

The judge/deep state are trying to provoke Trump into pardoning Flynn. That at least gives them another priceless Talking Point.

Read Flynn's plea agreement. He explicitly states that he is guilty as charged -- under penalty of perjury.

Most don’t get that reference Leo. (Very subtle.) I agree with you - some of that work is being called for on a wide scale.

If necessary, Trump will pardon Flynn when the time is right.

It seems more likely that the judge wants Trump to file an amicus curiae brief in this case.

Well, technically, a false confession *is* lying to the court.
Ghoulish, draconian, catch-22 are only a few words describing Flynn's situation.
I think the whole federal practice of scaring people into confessing to a lesser crime, to avoid the bigger whammy, needs to be reworked.
As do perjury traps and other underhanded tactics.
Such as politically driven destruction of a person before a fair trial.
People quickly lose trust in unethical authorities.

This is outrageous. This judge is acting as prosecutor and jury and judge all at once
********************************************
It’s even worse. The DemocRATS’ Judge Sullivan has assumed EXECUTIVE BRANCH POWERS and named the Prosecutor and assumed LEGISLATIVE BRANCH POWERS and confirmed his own nominee.

These EXTRA-CONSTITUTIONAL acts are meant, IMHO, to keep Flynn’s mouth shut through this year’s election campaigns.

I despise these people more than ever!

RE:”Independent my arse. This needs to be fast-tracked to SCOTUS.”

Then the Dems will say that Trump not only corrupted the justice department but also the SCOTUS, that the rule is law is dead without dramatic change in the election.

But yes, hopefully if things go nuts the SCOTUS intervenes

Great analysis, that is where they are teasing Americans as to where this might be going.

There shouldn’t be a sentence because DOJ has dropped the case....period.

Sullivan is trying to extend the game via infinite overtimes with Amicus briefs. I would call it “judicial outsourcing”.

DOJ is probably in conference with the DC Appeals Court asking them to order Sullivan to stop the Amicus and drop the case.

It’s all about “saving face” is seems.

The best defense in a criminal case like this is to make it clear that you have nothing to lose. Any prosecutor with an IQ over 40 would stay the hell away from a defendant like that:

Judge won’t allow defense to submit Amicus briefs.
Only for the anti-Flynn side.

I’m hoping that DOJ does the right thing and asks for emergency SCOTUS intervention

I don’t think that would work. What standing does the DOJ have to file such an unusual appeal?

The most effective course of action for the DOJ is to charge one or more members of the Mueller prosecution team with crimes related to this case.

So no matter what, in your cowardly mind the Democrats are always in charge of everything.

You make a good point about separation of powers.

That ruling is instructive about the right of the prosecution to end a case for any reason.

The gray area is the guilty plea. It is unknown for the prosecution to quit after they’ve won.

Even though it has been denied, I wonder if someone told Flynn off the record “they” would get his family eventually, by some means, if he didn’t accept the plea deal. It might not be by prosecution but a car accident, a grandchild hurt, a mugging gone bad, etc. You have to think these people have this capability.

Their standing is that they have the power to drop a case whenever there is entrapment, lack of evidence, coercion, prosecution misconduct, withholding of exculpatory evidence, etc., or any situation where the charges should of never been leveled.

In the case of Sullivan, DOJ can overstep Sullivan and go to the DC appeals court and ask for an order to stop the Amicus briefs fiasco.

Either way, if Sullivan goes rogue, he sets the case up for an immediate appeal/dismissal at the next upper level of court.
