The judge overseeing the prosecution of former National Security Adviser Michael Flynn wont immediately grant a U.S request to dismiss the case, saying hes willing to hear from outsiders who want to weigh in on what should happen next.
U.S. District Judge Emmet Sullivan in Washington said on Tuesday he would accept friend-of-the-court briefs in response to the dismissal request from Attorney General William Barrs Justice Department, according to the court docket. Flynn had pleaded guilty to lying to federal agents and was cooperating with the investigation before deciding in January to try to withdraw that plea.
The judges unusual move is a potential setback to the Justice Department and President Donald Trump, who has repeatedly attacked the case, part of Special Counsel Robert Muellers probe into Russian interference in the 2016 election.

The Supreme Court ruled just last week [United States v. Sineneng-Smith], holding that exactly the same games the Ninth Circuit attempted, and that Sullivan is attempting in this case, are a “drastic departure from the principle of party presentation,” and so constitute “an abuse of discretion.” [The Ninth Circuit reached out to amici (friends of the court) to decide a question never raised by the respondent.]
Why doesn’t Sullivan just sentence Flynn and be done. Let an appeals court sort it out.

The judge had all the authority he needed to deny Flynn's motion to withdraw his guilty plea. He could have simply denied the motion and sentenced him.
By taking this bizarre step of allowing amicus curiae briefs -- after rejecting such briefs at least two dozen times earlier in the case, according to Flynn's lawyer -- he has put himself in a position where he could conceivably be removed from the case immediately upon an emergency appeal by the defendant.

He can’t just give the money back, he has to do something to satisfy his handlers.
They need to appeal to SCOTUS to have this rogue judge removed from the case and the bench as far as I am concerned.

Let’s think about this for a minute. Threatening Flynn with contempt for changing his plea to innocent, is an improper tactic to keep him from changing his plea.
I think the whole concept is ghoulish. If you change your plea to innocent, damn it, I’ll make you a criminal.
BUT this is even more bizarre. The court isn’t reacting to Flynn changing his plea, the court is faced with DOJ dropping the case.
Threatening Flynn with a new crime for this is outrageous.

Accepting a parson under these circumstances wouldn’t be an admission of guilt, imo. In fact, Trump could slap down the judge in the pardon explicitly.

Exactly right, Sullivan is on this too deep, and his cover is blown. He has no choice but to deliver to his controllers.

When did Flynn ‘lie’ to the judge? When he pleaded ‘guilty’, knowing that he really wasn’t, or something?
