The defendant has a much stronger case to make than the DOJ. The DOJ has no “rights” that would be the basis of an appeal.

As far as I know, the DOJ has never come out and publicly stated in its court filings that there was any wrongdoing. Maybe that will change in the near future.

Even if “guilty” there are circumstances when such a plea/verdict can by nullified. Some of it deals with the “mechanics” of the plea, others deal with some type of misconduct or exculpatory discovery.

The judge is challenging the DOJ’s decision/authority to drop this case. DOJ will therefore appeal to a higher court. Once dismissed by DOJ, it’s no longer Sullivan’s case.

listen to DiGenova and Toensing about what the DOJ can do about Sullivan’s refusal to dismiss:

The most discouraging thing is how there are too many deep state traitors littered throughout every part of our gov’t , including this corrupt judge.

Sullivan is a good example of Deep State slime. He presided over the Senator Ted Stevens conviction. The prosecution team committed all kinds of felonies (falsified 302, perjury, obstruction of justice). He held them in contempt of court. Penalties? None. He needs to be investigated.

Thanks, so no matter how much prosecutorial misconduct was used to force his plea...none of that matters at this point and he is supposed to simply go to jail and fight it on appeal. I guess that’s his only option.

I’ve read books on Stalin’s Soviet Union...silly me, I didn’t think it could get that bad here.

This was the National Security Advisor, for heaven’s sake. When I read the details of this story the first thing that comes to MY mind is: How hard would it have been to get him to compromise U.S. national security?

I wish him well, and I hope his persecutors all choke on Hillary’s toe fungus. But In my mind he really comes across as an inept, bumbling fool.

Maybe so, but now he’s a HERO to many of us, as we much better understand the FBI and how to deal with them. Before him, many of actually would trust the FBI to be impartial. Not anymore!

Right. As if a plea is a statement of fact. As if an innocent person is never allowed to plead guilty.
