I am NOT defending Lucas, but...
...because the order applies across the board to ALL commercial establishments and does not single out churches for unique treatment this will, unfortunately, pass Constitutional muster.
The USDOJ gets involved when churches are treated more severely. I doubt that they can touch this.

Under the Commerce Clause, maybe. The mayors actions are a
prima facie bright-line violation of the Establishment Clause. Government cannot compel you to reveal any data in order to assembly freely in worship.
The mayor knows this, this is his bid to appease Moloch.
