Judge orders Michael Flynn’s former attorneys to execute another search for documents after new trove discovered

The federal judge presiding over retired Lt. Gen. Mike Flynn’s case issued a surprise order telling the former national security adviser’s previous attorneys to conduct another search of their entire case archive after it was revealed they failed to turn thousands of documents over to Flynn’s new defense team.

The ruling by Judge Emmet Sullivan was made public Tuesday afternoon after Robert Kelner and Stephen Anthony, Flynn’s former lawyers at the powerhouse firm Covington & Burling, claimed there were 6,800 records they had only just now unearthed and turned over to Flynn’s current defense team, which has been led by former federal prosecutor Sidney Powell since July 2019.

“It is FURTHER ORDERED that Covington & Burling LLP shall re-execute a search of every document and communication pertaining to the firm's representation of Mr. Flynn,” stated Sullivan’s ruling, which appeared on the public docket. “It is FURTHER ORDERED that Covington & Burling LLP is FORTHWITH DIRECTED to produce to Mr. Flynn's successor counsel all documents or communications concerning the firm's representation of Mr. Flynn that were not previously transferred in the rolling productions. It is FURTHER ORDERED that Covington & Burling LLP shall file a notice of compliance with this Order by no later than 12:00 PM on May 4, 2020.”

Around the same time Tuesday afternoon, a seven-page filing from the Covington attorneys was unsealed, which showed that Kelner and Anthony had just transferred thousands of documents that they had been sitting on for almost a year to Powell and Flynn’s new team. Earlier in April, Covington admitted it failed to transfer a number of emails and two hand-written notes over to Powell, but Tuesday showed that this was just the tip of the iceberg.

That’s not a mere oversight. That’s a deliberate move to obstruct justice. No different than Hillary deleting thousands of subpoenaed emails. I hope they get charged big time.

I figured those shysters at Covington were in cahoots with the FBI/DOJ. Hell, they even tell the same BS lies the Clintons do. I’m thinking there’s a treasure waiting at the end of this for Flynn and Powell. Is this a first for Mueller? I know he’s been dirty for a long time, but conspiring with the defendant’s attorneys.

Judge Sullivan should cite a few for contempt for resisting his order. There is no reason a judge should tolerate what is going on.

Sullivan is a corrupt SOB who is utterly contemptible.

He destroyed the late Senator Ted Stevens career with a false conviction and only dismissed the charges after the election was over and Stevens had lost.

He has had more than enough evidence for the past year to dismiss all charges against Flynn and sanction the DOJ prosecutors and Flynn’s first attorneys who collaborated with the DOJ to force Flynn to accept a plea bargain. But he continues to do nothing.

Sullivan is a disgrace.

WRONGO! Flynn will get off. Too much has been exposed to the light of day. His lawyer Sydney Powell knows exactly how these deep state shits operate and has proven this in her work for Flynn.

They sure did and IMHO they were part of the team to make sure that Flynn saw some jail time.

Good hunch! What suprises me is them turning things over now. Why? They are already in deep $hit. Judge has been biased the entire time. No one could be that stupid. He is bending the law to get Flynn and he may have run out of time and options.

The judge just ordered the old attorneys to hand evidence of their malfeasance to the new attorney. You know, in case the client wants to sue their asses off.

He can acquit Flynn after that. But making them cough up ALL the documents first is better in the long run.

Can’t say I fault Sullivan here. He has to walk a very fine line in this case because Flynn already pled guilty — and there are legal ramifications to that.

Pretty sure there wasn’t. Powell was very clear in her filings that there was no “investigation” that was a predicate to the “investigative” interview. Without a predicate investigation, the FBI was engaged in fishing and entrapment.

If there had been a FISA warrant on Flynn, there would mean there was a predicate investigation.

The evidence is overwhelming that this is an utter fraud on the court. It was Sullivan’s duty to act a year ago.

He’s shown by past actions that he’s willing to stand by while careers and lives are destroyed.

If he had an ounce of integrity, he would have already done the right thing.
