A 9th U.S. Circuit Court of Appeals panel voted unanimously Friday to suspend an order it issued earlier in the day to block a central pillar of the Trump administrations policy requiring asylum seekers to wait in Mexico while their cases wind through U.S. courts.

Wrong!. Trump has had many new Conservative Justices assigned to the 9th but it is not yet a majority R court, although it will be fairly quickly.
My bad. I should have read it more clearly. The appeals court is suspending its own order. I thought this was in reference to the original order. That’s what I get for not reading the whole story. Great news. Flame away.
I think the SC is getting upset with these blanket orders limiting presidential power.

It was a 3 judge panel with two Dem appointees and 1 Republican appointee and the ruling was 2-1.
Nope, sorry the end result is the only thing that matters and the end result for conservatives in court is losing. Close does not matter. Conservatives have been close to winning in court for a half a century. Ask yourself why obama did not bother with judicial appointments? The real answer is the left OWNS the entire judicial branch of government and they know it. The left also owns the DOJ. Strictly limiting government power is the only answer. Just like the libs who believe socialism will work if the right people are in charge. Conservatives are holding on to the belief that virtually unlimited power usurped by the judicial branch will be fine if we just have the right judges. Both groups are believing in a fairy tale.
There are plenty of conservative lawyers who would have been pleased to step up and become federal judges for President Trump. I am one of them. However, here in Oregon the Administration allowed Senator Wyden to control the nomination process, and he carefully screened out the one reliable conservative of which I am aware who bothered to apply (I didn’t); the final slate sent to the White House included more than one individual who had made substantial donations to the Obama campaign. There is a vast Resistance machinery, largely untouched by the President, that carefully screens out conservative nominees (and policies) from rising to White House attention. Do not doubt that if the President focused on firing massive numbers of Resisters, and replacing them with conservatives, that replacements could be found. They can be easily found, active in conservative politics all over the Nation, and easily recruited. There has just been no will to do so.
So without acknowledging of your comments were incorrect based on incorrect information, you just write another paragraph saying the same thing.

However, keep in mind that most cases are heard by a 3 judge panel, so even when it is flipped, you still end up with most or all Dem appointed judges.
If the SCOTUS already ruled that it’s legal, why would Trump need to appeal this lower court ruling?
But the end result is what counts, not how close it was.

When things get iffy for the left in the 9th the issue will go somewhere else where it will be close but they will still win. This is never going to change. Remember just because Trump appoints one of these judges does not mean they will rule in favor of conservatives when the chips are down. Ninety percent of them won't and we will still lose.
As a rule of thumb, there are no conservative judges. It is not the nature of conservatives to seek these jobs and never will be.
Now when I say that obviously that's not 100 percent correct. Sure once in a great while a real conservative who sticks to principle will seek a life long government job but they are so rare that the numbers will never work in our favor. We will only continue to lose.
While Trump has the power, sure do the best we can with appointments but know this is never going to be the answer long term. We must limit government power and make judges both accountable to the people and limited in their time on the bench. Lifetime tenure has to end.
Like I said earlier the job of federal judge attracts all the wrong people and that is never going to change.
I just read it and am still trying to figure it out. Clear as mud.
I don't see any mention of any new filing between the issuance of the first order and the second order later the same day. I did read that the DOJ expressed strong displeasure with the ruling and indicated that a USSC appeal is imminent, so I assume this verbal smackdown prompted the three judges to make a little "adjustment."
Does anyone have a different take? What am I missing?
