Trump admin. can enforce ban on Title X funds for clinics that promote abortion, Ninth Circuit rules

The U.S. Court of Appeals for the Ninth Circuit ruled that the Trump administration can enforce a rule denying Title X funds to family planning clinics that promote abortion.

In an opinion released Monday and authored by Circuit Judge Sandra Ikuta, the Ninth Circuit vacated multiple injunctions from lower courts against the Protect Life Rule and sent it back to the lower courts for further proceedings “consistent with this opinion.”

“Regulations issued in 1988, and upheld by the Supreme Court in 1991, completely prohibited the use of Title X funds in projects where clients received counseling or referrals for abortion as a method of family planning,” wrote Ikuta.

“In light of Supreme Court approval of the 1988 regulations and our broad deference to agencies’ interpretations of the statutes they are charged with implementing, plaintiffs’ legal challenges to the 2019 rule fail.”

Ikuta took issue with the term “Gag Rule” that critics use, as Ikuta wrote that the Trump administration regulation, created in March of last year, is less restrictive than the 1988 regulations.

“But the 2019 rule is less restrictive in at least one important respect: a counselor providing nondirective pregnancy counseling ‘may discuss abortion’ so long as ‘the counselor neither refers for, nor encourages, abortion’ … There is no ‘gag’ on abortion counseling,” noted Ikuta.

Circuit Judge Richard A. Paez authored a dissent, being joined by Chief Judge Sidney R. Thomas and Circuit Judges Kim McLane Wardlaw and William Fletcher.

“Three separate district courts in well-reasoned opinions recognized that the Rule breaches Congress’s limitations on the scope of HHS’s authority and enjoined enforcement of the Rule,” dissented Paez.

“In vacating the district courts’ preliminary injunctions, the majority sanctions the agency’s gross overreach and puts its own policy preferences before the law.”

California Attorney General Xavier Becerra, whose state was among those fighting the rule, denounced the Ninth Circuit opinion in a statement.

“This reckless rule is just another attempt by the Trump-Pence Administration to roll back women’s access to reproductive healthcare,” stated Becerra.

“Leaving women in the dark about their healthcare and restricting doctors from providing candid advice is simply not in the best interest of public health. In California, we will continue to fight for comprehensive reproductive healthcare, including safe and legal abortion.”

However, Steven Ertelt of Lifenews.com defended the rule, writing that it “doesn’t require doctors or nurses to withhold information” but rather “merely prevents Planned Parenthood from promoting abortion using taxpayer funds.”

“The abortion chain could continue to receive Title X funds if it stops aborting unborn babies or if it completely separates its abortion business from the real health care services it provides,” stated Ertelt.

“Meanwhile, community health centers vastly outnumber Planned Parenthoods and provide far more comprehensive medical services to low-income and minority women across the country. They still have access to those funds, assuring that low-income individuals still will have options for their medical needs.”

SBA List President Marjorie Dannenfelser also celebrated the 7-4 ruling. “Abortion is not ‘family planning’ and a strong majority of Americans – including 42 percent of Independents and more than one third of Democrats – oppose taxpayer funding of abortion," she said.

The 9th circus has actually become a court again. This ruling by the full 11 judges is another win for Trump. Anybody getting tired of winning.

Trump is not only winning but is doing so in spite of an incredible headwind created by media, deep state, Democrats, treacherous or weak Republicans and international adversaries (e.g. China, etc.).

Makes you wonder how good Trump could be without all those forces arrayed against him.

I’ve come to think that Trump is one of those transformational, significant, larger than life personalities that the United States of America seems to produce from time to time over the course of our history.

Our country seems to produce a few people every century who defy convention and manage to make an indelible mark on the world: George Washington, Ben Franklin, Thomas Jefferson, Edison, Lincoln, MacArthur, Reagan, among others. I’d include Trump in that list.
