I don’t think much of cases like this brought four years after the fact.
If you’re having issues, resolve them in real time. Don’t come whining back four years later.

The key to this is whatever contract she signed to work for them. If it has a clause for overtime pay, then her action has some merit. If it doesn’t, you are performing as a salaried contractor and overtime is not factored into the salary. The salary is what you are paid to work as long as your employer says to work. That was explained to me when I attempted to transition to management. The truth in many fields is that entry-level salaried posts actually paid less per hour than upper hourly positions that were covered by collective bargaining.
