Andrew McCarthy: Why wasn't Andrew McCabe charged?

The Justice Department announced Friday that it is closing its investigation of Andrew McCabe, the FBI’s former deputy director, over his false statements to investigators probing an unauthorized leak that McCabe had orchestrated. McCabe was fired in March 2018, shortly after a blistering Justice Department inspector general (IG) report concluded that he repeatedly and blatantly lied — or, as the Bureau lexicon puts it, “lacked candor” — when questioned, including under oath.

Why not indict McCabe on felony false-statements charges? That is the question being pressed by incensed Trump supporters. After all, the constitutional guarantee of equal justice under the law is supposed to mean that McCabe gets the same quality of justice afforded to the sad sacks pursued with unseemly zeal by McCabe’s FBI and Robert Mueller’s prosecutors.

George Papadopoulos was convicted of making a trivial false statement about the date of a meeting. Roger Stone was convicted of obstruction long after the special counsel knew there was no Trump–Russia conspiracy, even though his meanderings did not impede the investigation in any meaningful way. And in the case of Michael Flynn’s false-statements conviction, as McCabe himself acknowledged to the House Intelligence Committee, even the agents who interviewed him did not believe he intentionally misled them.

Your post would make sense if Flynn just took his guilty plea and went home. Instead, he has now decided to engage in a long, drawn-out (and presumably expensive) legal process to undo his guilty plea on the basis of facts that would have been devastating to the prosecution and the entire DOJ if they had come out in a trial.

This article is very instructive, especially for those trying to understand why it is so difficult to make any progress at the attempt to drain the swamp. Consider the problem that you would have if you were the visiting team and the home team would provide the referees, they would be in charge of inflating the footballs, your fans wouldn’t be allowed in the stadium, and you had no benches, water, or towels on your side of the field. Moreover, the home team would be allowed to amend the rules without notice to the visiting team and without begin required to provide a copy of the new rules. Additionally, your team owner is tweeting the referees throughout the game complaining about their calls. I wonder what the betting line would be?

What chance do you think Sidney Powell had of being confirmed as Attorney General? Or anyone else threatening to the deep state? Barr snuck in only because he was Bush’s AG, and assumed to be establishment. He hasn’t gone near far enough to prove otherwise, yet. But remember the choice for DNI, the Republican congressman who is very, very capable. He had no chance, and his nomination was pulled.

Until he gets control of the 5 or 10 traitors within the GOP Senate caucus, he will be constrained on who can be AG, or head of any intelligence agency.

The FBI (Wray) and Justice Department are in full protect mode. The last thing they want is for McCabe to reveal everything. That is how the Deep State always protects itself. it has to to survive.

The flaw in this thinking is that for the FBI to survive, all the individuals in it must never be prosecuted.

Total nonsense.

Prosecute them. The FBI, if needful, will come out the other side, smaller, perhaps less powerful, but compatible with Constitutional government.

This thinking believes that individuals can burn down the entire government.

They can not.

There is not enough trust in the Media or alternative media to do that.

This is what we get after 8 years of 0bama.

He and his team spent every minute of those 8 years installing THEIR people everywhere that counted in order to insure what we have to deal with now.

Also a big nod goes to the many corrupt republicans in DC who are in bed with the corrupt dems and refuse to get to the bottom of anything because it’ll incriminate THEM as well..


It’s the bipartisan nature of the coup that makes it so insidious. The rot is several levels deep at Main Justice. No AG can tackle that himself. They need the full support of a political party on their flanks to root out the swamp rats there. Sadly, with President Trump in the White House that will never happen.

That sums it up. I'm surprised Trump has had so much success getting so many young, conservative, Constitution-abiding, strict constructionist judges confirmed by the Senate.
