So, why couldn’t Repubs appeal to the SCOTUS that the articles are unconstitutional?Because SCOTUS has too much power already, and grabs more every chance they get.
When the idiot Bush filed Bush v. Gore, a case the Court should never have heard, they jumped in with both feet and opened the door to the challenges against the Electoral College which they are now hearing.
The Court has no Constitutional role in elections. Period.
Similarly - impeachment is a SOLE power of the House of Representatives. The judge of how they exercise that power is the fact that they have to face the people every two years. If we don't like the way they do business, we are supposed to kick them out.
