Levin: Pelosi’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act...
Mark Levin on Facebook ^ | 12/19/19 | Mark Levin

Posted on 12/19/2019 5:38:16 AM PST by conservative98

Nancy Pelosi was apparently advised by leftwing Harvard law professor Lawrence Tribe to delay sending the impeachment to the Senate. So she’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act.

Here’s what Mitch McConnell and the Senate Republicans must do in response: The Senate has the sole power under the Constitution to adjudicate an impeachment. Therefore, Pelosi is attempting to obstruct the Senate’s power to act on its constitutional authority. McConnell should immediately put an end to this and declare the impeachment null and void as the speaker has failed to complete the impeachment process by timely sending it to the Senate for adjudication. McConnell has no less authority to unilaterally make such a decision than Pelosi does to withhold the administrative notification of an impeachment to the Senate either indefinitely or with conditions. Her effort to cripple the presidency and blackmail the Senate must be defeated.

"I am reminded of something I read years ago HISTORY IS MESSY.

Like it or not we are witnessing history in the making."

The history making started in earnest when the "country" allowed the fraud Soebarkah to usurp the Presidency in plain view for 8 years.

The 1064 day long coup against President Trump and our individual votes as citizens should be of no surprise to anyone.

Not coincidentally, many of the same people have participated in both unconstitutional and illegal acts...including Harvard "law professor" Lawrence Tribe.[1][2]

As much good as Trump has done, he's probably only been able to drain 1% of the swamp and when he leaves office in January 2025, unless there is a real awakening, our oligarchs & ruling class elitits, the "educational" system & tens of millions of foreign nationals in our country illegally will make sure that any 5% that was drained will be backfilled 10%.

Yeah. It was that from the start. But damn it they need to be put down once and for all. They’re begging for it.

They don’t need 2/3 for acquittal, they only need a majority. They need 2/3 for conviction.

Very wishful thinking approaching fantasy land.

I say this because in today’s corrupt world it will not be allowed to happen.

This rat victory may mean a defeat in terms of a few seats, but to starve their constituencies in the manner you described would backfire as the swamp is in full control of the media and other propaganda tools that easily sway public opinion.

Someone on FNC said they have 2 months or 2 weeks before the election to deliver it to the Senate.

"The articles are on the House web site:

RESOLUTION Impeaching Donald John Trump, President of the United States, for high crimes and misdemeanors.

All Mitch has to do is have an aide print them out, and "deem" them delivered."

Exactly.

LOL. All that means is he can’t unimpeach. He can override a COURT imposing a criminal sanction, but he cannot overide Congress imposing an impeachment sanction.

“Best thing the Senate can do is have hearings on the Ukraine corruption. Publicize how Biden, Pelosi, Kerry, Schiff and others used the Ukraine as a prosecutor free corruption zone and laundered the money through their dumb children such as Hunter Biden and Paul Pelosi. It will demonstrate just how corrupt these lowlifes are, the basis of Trump’s desire to root out the corruption, and why at its core the impeachment fiasco was an attempt to hide this corruption. When this is over, it is more likely that Pelosi will lose her office in shame than Trump losing his. Sure there are some Republicans such as Romney who had their hand in the corruption and will try to prevent a real investigation.”

************************************************************

Perhaps. But, what if Linda, Burr or others, have dirty hands that they need to keep from being exposed?

The Senate knows the articles of impeachment. The Republican leadership should deem the articles delivered, call in Roberts and get the show on the road.

If you watched Mitch’s speech a little while ago he is signaling dismissal to San Fran Nan. I quote “ the articles of impeachment are constitutionally incoherent “. There is not going to be a trial. Look for a one day deal with a vote to dismiss.

Except Yertle cannot “declare” anything “null and void.” It needs to be voted on. So I want to know how Levin gets around the rule change. Because THIS is much different than a vote to acquit: this would offer sufficient confusion and archane language that the neverTrumpers can vote AGAINST a rule change while still feigning support for Trump.

I want to know specifically how he would have Yertle deal with that, cuz that’s what I think will happen. Hope I’m wrong.

Oh, and realize if Yertle does this, the DemoKKKrats will sue and try to get this in front of the USSC.

Nancy did her job, so she can go back to her base and say “She delivered her end of the bargain”.

I still say she really didn’t want this, but the mobs gave her no choice. And the Rats are nothing without a fired-up base.

You are right of course but I fear extreme election fraud, which the democrats always get away with.

"So shouldn’t President Trump appealed to the Supreme Court to nullify this “impeachment” on the grounds that it is unconstitutional because no crime, misdemeanor, bribery, or treason was committed? What would be the outcome?"

Supreme Court will say this is a political question and a separation of powers issue and they have absolutely no constitutional authority to get involved."

=========================================================================

Either Trump sends his argument to SCOTUS, or the Senate sends a complaint there stating the House is obstructing their Constitutional mandate.

SCOTUS does as you suggest, says this is political and refuses to get involved.

And since there is no law, nor Constitutional requirement that the House has to physically send a paper copy of any articles of impeachment over to the Senate side, the Senate should take up the articles of impeachment that are currently publicly available on the House web site and do whatever it is they are going to do (hold a trial with witnesses, or majority leader McConnel dismissing them as fraudulent, etc)

The House takes their case to SCOTUS arguing the Senate can't do that without them "sending" the articles over.

SCOTUS is then going to do what? Go against what they just opined...say it's now not political and takes up the House's argument?

As long as this coup is happening, let's go to war...get all the dirty political laundry out in the open for all to see.

I had to put up with the whole JD/ConLaw thing, and managed a little better than a "D." What are you having in the bar? I'll join you and buy a round in celebration of impeachment! Trump is going to crush the DEMs.

Mitch should have set a deadline, but instead we got a wink and a nod to her. So damn typical. Where’s the outrage, Republicans?

“According to the Democrats, nothing they do is unconstitutional. Ever.”

And nothing is ever partisan either.
