Nancy Pelosi was apparently advised by leftwing Harvard law professor Lawrence Tribe to delay sending the impeachment to the Senate. So she’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act.

Here’s what Mitch McConnell and the Senate Republicans must do in response: The Senate has the sole power under the Constitution to adjudicate an impeachment. Therefore, Pelosi is attempting to obstruct the Senate’s power to act on its constitutional authority. McConnell should immediately put an end to this and declare the impeachment null and void as the speaker has failed to complete the impeachment process by timely sending it to the Senate for adjudication. McConnell has no less authority to unilaterally make such a decision than Pelosi does to withhold the administrative notification of an impeachment to the Senate either indefinitely or with conditions. Her effort to cripple the presidency and blackmail the Senate must be defeated.

I was thinking the same thing. My wife and I recently adapted our 2 year old toddler granddaughter to raise. When she wants attention, she throws a little temper tantrum. We have to put her in her crib until she decides to behave herself.

Watching Pelosi manage this impeachment process in the House reminds me of "managing" our toddler.

I think Pelosi knows how badly they have screwed this impeachment process up already, to the point where they can't back out of it now.

She knows the polls for the impeachment have sunk the democRATS. She knows Trump's numbers are rising as a result of their botched impeachment. She knows Trump is going to be reelected no matter what they do now.

So she is doing all she can do and that is to throw the who process into chaos by withholding the articles from being formerly sent over to the Senate.

IOW, she throwing a toddler temper tantrum in her frustration to keep the attention on the democRATS' hatred for Trump. She knows if she sends it to the Senate, that they will deal with it quickly and abruptly and the whole mess will be over with is a short while.

To keep the attention on her and the House, she is throwing a temper tantrum to keep the media spotlight on the democRATS and not the Republicans.

Democrats “rules” are kinda funny... the only way the GOP Senators can prove they’re “impartial” is to convict and remove Trump. Also odd, is just a few weeks ago, the Founders were “racist old white men” none of whom were worthy of a statue in the park. But now, they and the Constitution are “sacred”... as in this “solemn” case of impeachment, Speaker Pelosi prays for (preys on?) the president... and only by his removal can the Republic (aka: Deep State) be saved! #RustyIrony

Do they really believe we don’t see it for what it is?

Maybe she wants to hold it up until they can impeach Pence. Then they can send both at once to a Dem majority in the Senate in 2021. Making her the President. In her dreams!

Interesting thought. The RATS in how they voted by simple majority to take away the rights of the minority in conducting this impeachment have completely demonstrated why the Framers established a constitutional republic, not a democracy. Having gone to that extreme, you're right, they may as well go just go full blast and impeach Pence, and while they're at it, throw in impeaching Kavanaugh for the cherry on top. They can charge Pence with aiding and abetting the obstruction of Congress and abuse of power, and they've already got a laundry list to charge Kavanaugh with. Pass a rule to make the hearing on each one day and they deliver even more goodies to their supporters for Impeachmas.

You know the hardcore ones like Mad Max and the Squad will be firmly behind it leaving just those "I looked at the evidence/I voted my conscience/blah blah" phony clymer Democrats who made a show of wringing their hands over the past few days. Why would they would draw the line now? Whatever leverage got them to go along with this charade will continue to work.

He has the pardon power for as long as he is in office. He loses no power just because the House formally accuses him with articles of impeachment.

The actions of one Congress don't carry over to the next. So if this Senate doesn't have a trial, the House would have to re-impeach after the election.

Correct. All the constitution says is that the Senate has the power to “try all impeachements”. The impeachment exists therefore the Senate can try it. It doesn’t matter that Madame Speaker can’t find a box to put it in. I know where she can put it.

I guess this is why I’m not a big Levin fan: he always correctly assesses what the enemy is doing, but he never gets around to innovative legal RESPONSES.

Sounds like a pretty clear legal response to me.

Article II, Section 2 provides:

[The President] ... shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.

He gets the power back if is acquitted is the way I read it. If the house doesn’t send the articles to the senate, is he impeached? We’ll find out in a few..

McConnell should give her a week to release the impeachment to the Senate and at the same time schedule a date certain vote to dismiss it with prejudice for failure to prosecute meaning they can never bring that particular impeachment issue up again. Dems will have to find some other issue, perhaps they don’t like the color of his suit, to impeach him on. This should underscore for independents during the next election that Dems in Congress wasted all this time on impeachment and have no interest in doing the business of the people and should not be given the responsibility of a majority

My wife had an interesting take on why Pelosi is sitting on this. Simple really. She’s doing it to protect Biden and his kid. Pelosi knows if she takes this to the Senate then Trump gets to call every one of these “Rats as a witness.

The meaning is that he can’t pardon someone that is impeached...else he could pardon himself and impeachment would never be effective against the president.

This means offenses except impeachment. If a judge, for instance, is impeached, the president doesn't have the power to pardon that judge.

12) Full Title-1 surveillance was done on the entire Trump family and administration for two years. Think about what was available for Weissmann/Mueller to leave for Nadler and the DNC. All of it perfect for slow leaking to the media during an election year....

13) Impeachment 1.0 could simply have been the method, the legal pathway, to get to all of that information. Thus holding the articles for a little while til the courts grant benefit from their existence within the three pending cases in early Januar

Good post. If the GOP had a spine they’d do exactly what you laid out, if we capture all the seats in the House that are in play then the iron would be hot and it would be time to strike. But even if we were to take those seats the GOP would blow it. They always do.
