I would assume only Chief Justice Roberts could call a mistrial. if you want to play by trial rules, Roberts could rule that the impeachment procedure was prejudiced from the start and exculpatory evidence was denied entry into the record and dismiss the charges with prejudice.

More interesting to me...FISA will have to come up in the Senate trial. The Constitution states that the Chief Justice must preside in an impeachment trial. In this case, being the head of the FISA, the Chief Justice becomes a ”fact witness”...the judge cannot be a judge and a witness. So Roberts will have to relinquish the Chief Justice title to be a witness...and the Chief Justice title must be passed to another member of the Supreme Court. Makes me wonder if this is a move to remove Roberts from his position as Chief Justice.
