Democrats repeat failed history with mad dash to impeach Donald Trump

“Let them impeach and be damned.” Those words could have easily come from Donald Trump, as the House moves this week to impeach him. They were, however, the words of another president who not only shares some striking similarities to Trump but who went through an impeachment with chilling parallels to the current proceedings. The impeachment of Trump is not just history repeating itself but repeating itself with a vengeance.

The closest of the three prior presidential impeachment cases to the House effort today is the 1868 impeachment of Andrew Johnson. This is certainly not a comparison that Democrats should relish. The Johnson case has long been widely regarded as the very prototype of an abusive impeachment. As in the case of Trump, calls to impeach Johnson began almost as soon as he took office. A southerner who ascended to power after the Civil War as a result of the assassination of Abraham Lincoln, Johnson was called the “accidental president” and his legitimacy was never accepted by critics. Representative John Farnsworth of Illinois called Johnson an “ungrateful, despicable, besotted, traitorous man.”

The Trump impeachment is even weaker than the Johnson impeachment, which had an accepted criminal act as its foundation. This will be the first presidential impeachment to go forward without such a recognized crime but, like the Johnson impeachment, it has a manufactured and artificial construct. The Trump impeachment also marks the fastest impeachment of all time, depending on how you count the days in the Johnson case.

The Democrats political need to avenge on Trump precluded all possibility of a building a more robust and bipartisan case against Trump.

Future Democrat impeachment efforts against Trump will be widely dismissed as crying wolf.

Best outcome for the Democrats would be for them to vote it down tonight, reserving for themselves the right to bring it up again in the future.

There’s no need to rush it through when judicial review of the President’s claims haven’t even been exhausted yet.

No good reason has been advanced by the Democrats to impeach Trump tonight.

If they insist on going ahead with it, history will not judge them kindly.

The whole problem with that strategy is that Trump has done nothing extraconstitutional, so trying to build a bipartisan evidence based case is truly a Sisyphean task. So the DemocRATs are moving forward with what they have. As the song says, "Nothin' from nothin' leaves nothin'."

Democrats have two things to run on: hate Trump and no record of positive accomplishments.

This impeachment has a sinister aspect not even considered in the Johnson impeachment - the Dems have stated that after this attempt fails they could reintroduce impeachment again -- and again. Such a threat passes beyond just trying to remove a president; it threatens to undermine our whole system of Constitutional governance.

What keeps us from the snares of parliamentary government is the principle of the separation of powers. The president has broad powers to act as he/she sees fit - with some limitations of course but undefined. That is the dynamic of establishing balance of power in such a system (NOT intended to be strictly democratic!)

What the Dem House is doing is canceling the president's prerogative to appeal to the courts to protect executive privilege - thus eliminating such protection of executive power. The impeachment article of 'Obstruction of Congress' (which is not a stated Constitutional principle) attempts to nullify the recent SCOTUS decision to review Prez Trump's challenge to having to release his financial records; the whole system of checks and balances is thrown in to a cocked hat!

What the Dem House is doing is attempting to ensnare POTUS as a servant of a House majority thus establishing a parliamentary system under our Constitution - likely an untenable political position.

In my view the White House should bypass the Senate altogether! If the House passes the Articles of Impeachment the WH should appeal directly to SCOTUS on the grounds of those articles eliminating our Constitutional form of government.

Unfortunately, if you look at the federal *seditious conspiracy* statute, it requires violence, or conspiring to commit violence.

Conspiracy of any kind is a tough case to prosecute because it requires a showing of what people are*thinking* rather than *doing*.
