Under the rules of the Congress, they can fashion it into an additional charge. As an attorney here’s the part I would advise my client to simply put his damn tweet away and pipe down and get back to work—let it just play out rather than making matters worse. You gotta just know they are having heart attacks over this just now over there. You’d be insane or delusional to somehow spin that little incident into something positive. He stepped in it big time.
