Why not vote? Democrats say it's impeachment either way

WASHINGTON (AP) — It's impeachment because House Speaker Nancy Pelosi says it is.

That's the legal position of House Democrats, and they are sticking with it, for now, even as President Donald Trump decries impeachment as "illegitimate" without a formal House vote to start it. Trump has said he won't cooperate with the impeachment investigation, which is looking into his dealings with Ukraine, unless there is a vote and Republicans are treated more fairly.

For the Democrats, there are legal, strategic and political reasons to stay the course.

THE LEGAL RATIONALE

Under the law, Democrats say they have no obligation to hold a vote. The Constitution gives the House "the sole power of impeachment" and the Senate "the sole power to try all impeachments." And it dictates the removal from office of an impeached president who is convicted by the Senate of "treason, bribery, or other high crimes and misdemeanors."

Congress is left to fill in the details. And there is no requirement for a vote under House rules. Republicans are pointing to precedent. They note that the House held votes to authorize impeachment investigations against Presidents Richard Nixon and Bill Clinton.

Well Lindsey says no for the Senate and that makes a stalemate, But this still will not stop the actions that are being taken against the Deep State. They will get overwhelmed.

What does the Constitution say about it?

“The House of Representatives shall choose their Speaker and other Officers; and shall have the sole Power of Impeachment.”

Whittled down to the nub:

“The House of Representatives shall have the sole Power of Impeachment.”

Not “The Speaker of the House.”

“The House of Representatives.” That means all 435 take a vote.

I would like to see the DOJ appoint a special prosecutor into for Obstruction of Justice for any and all that are using their official Government Authority to block/hinder the investigation into Corruption associated with Ukraine, China, 2016 election, etc.

Because Nancy Pelosi prefers to have it both ways. She knows that voting on impeachment or voting to formally begin the impeachment process may hurt Democrats running in competitive races so she’d like to avoid that. Yet she wants the headlines that the impeachment investigation would generate. So with the administration refusing to honor subpoenas she can go out there and say that the Democrats want to complete their investigation and vote impeachment if they find it’s “justified” but since that evil ‘ol Trump won’t won’t cooperate they can’t complete their work. They can beat Trump up with claims of obstruction and not have to go on the record.

Mitch McConnell needs to send out Subpoena too

I read last night that McConnell and his wife Elaine Chao (who is Trump's Secretary of Transportation) increased their net worth from $3 million to nearly $35 million since 2004. The illegally profited from foreign money, including China.

In 2016, shortly after President Trump's inauguration, McConnell met with Trump in the Oval Office and chastised him for his rhetoric about "draining the swamp." McConnell implicitly threatened that unless Trump backed off, no meaningful legislation or judicial appointments would get through the Senate.

The Enemy is larger than any of us realize.

Here is the problem with certain people not understanding the CONTENT of the words in the Constitution.

The Constitution states it is the House, not the speaker of the house, not a committee of the House, not one party in the House, not a drunken cloakroom voice vote, the House.

That means all of the House. Unfortunate that people keep trying to change the meaning of words and statements.

Well I call bullsht on your claim re what McConnell told Trump. Trump has not let up on his swamp rhetoric and a record number of Judges have been appointed.

Asfor his net worth, unless you have info showing illegality, who cares.

We have judges. I don’t have a list of meaningful legislation, but the Senate, as a whole, has been ok. Individual Senators, not so much.

Winning a legislative seat and having a Cabinet appointment are a path to more riches....no argument. It’s not right, but it is what it is.

No one has successfully bullied POTUS and all I have seen is the Trump Curse in action. I also see much progress under Trump and much grit. Maybe Mitch said it was a dangerous course. It is. Maybe Mitch was fearful, knowing the Swamp’s depth and breadth. He (& Trump) should be aware of that and seem to be.

But Trump persisted. The progs celebrate their crooks persisting. Why fret if our side persists fighting those same crooks?

They do have to vote to pass articles of impeachment.

They certainly do not have to hold a vote before then. The House has the absolute right to make its own rules, under existing rules what Pelosi is doing is perfectly legal.

Right.

Nobody has suggested that Pelosi can send Articles to the Senate without a vote.

What they are trying to do is to advance Articles to the floor for a vote without any procedural votes and without allowing the minority to participate.

As far as I can see, doing it this way is sleazy, underhanded, dishonest - and perfectly Constitutional.
