CIA sent criminal referral on whistleblower's complaint to DOJ: NBC

A top CIA lawyer attempted to make a criminal referral to the Justice Department weeks ago based on allegations made in the recently released whistleblower complaint, NBC News reported Friday, citing officials familiar with the matter.

CIA general counsel Courtney Simmons Elwood, who was appointed by President Trump, attempted to make the referral, signaling that she and other officials determined that a crime may have been committed based on the whistleblower's allegations that Trump sought to get a foreign government's assistance in the 2020 election.

The timeline of Elwood's contact with the Department of Justice had been previously reported, but NBC is the first to report that she intended it to be a criminal referral over Trump's conduct.

DOJ later declined to launch a criminal probe into Trump's Ukraine call, saying in a statement that it had determined "there was no campaign finance violation and that no further action was warranted."

Elwood had been part of a conference call with John Eisenberg, chief legal adviser to the White House National Security Council, and top DOJ national security lawyer John Demers on Aug. 14.

Elwood and Eisenberg reportedly told Demers that the whistleblower's claims were worth DOJ scrutiny. Elwood was following rules that say there must be a report if there is a reasonable basis to a whistleblower's accusations, which is defined as "facts and circumstances…that would cause a person of reasonable caution to believe that a crime has been, is being, or will be committed," officials told NBC.

DOJ officials have reportedly said that there were unclear on if Elwood was seeking to make a criminal referral and that she was vague on the subject when they reached out for clarification.

More proof the Clowns need to be put out of their treasonous misery and shut down immediately. They would of had to have gone through Haspel to get to the DOJ. The traitors have completely infiltrated the Agency’s ranks and that goes for the DOJ as well. What a bunch of worthless lawyers that sit around on taxpayer paid time entertaining stupid, frivolous ways to take down their boss? What a disgusting revolting situation for something as horrific as this to be going on this long into the Administration

DOJ inspector general completes investigation into alleged FISA abuse - September 13, 2019

Justice Department Inspector General Michael Horowitz has officially completed his investigation into alleged Foreign Intelligence Surveillance Act abuses by the Justice Department and the FBI.

Rep. Doug Collins, the top Republican on the House Judiciary Committee, revealed in a letter Thursday that Horowitz notified Attorney General William Barr of the completion of his investigation earlier in the day.

Horowitz said in a letter to congressional leaders that his team is in the "process of finalizing our report by providing a draft of our factual findings to the Department and FBI for classification determination and marking." Once redactions are made and the report is returned to the inspector general, Horowitz's team will "proceed with our usual process for preparing final draft public and classified reports, and ensuring that appropriate reviews occur for accuracy and comment purposes."

So where it stands right now is not clear to me.

It could be the Barr/Durham investigation is why we haven't heard the results as of yet.

The whistleblower’s complaint is now at the center of House Democrats’ impeachment inquiry into Trump.

Not the ACTUAL phone call...but the PARTISAN complaint.

They are supposed to be a foreign intelligence agency and under the damned Patriot Act are given a bunch of powers to operate against foreign threats to the United States. The President’s conversations are none of their damned business.

POTUS might be a special case but what are they supposed to do if the foreign actor is working with a US citizen?

...the Intelligence Community IG’s report that was filed only after the rules were changed four days in advance to allow a hearsay complaint ...

Turns out that was fake news. Nothing was altered that affected this case.
