Justice Department Inspector General Michael Horowitz said Wednesday that he referred ex-FBI Director James Comey for criminal prosecution.
We are required by the [Inspector General] Act to send information that weve identified that could plausibly be criminal to the Department of Justice, said Mr. Horowitz, confirming what amounted to a criminal referral.
The Justice Department ultimately decided not to prosecute Mr. Comey despite Mr. Horowitzs team concluding he improperly leaked information to the news media. The documents leaked by Mr. Comey were sensitive, but not classified.
Mr. Comey asked a law professor friend to share with The New York Times a memo detailing his conversations with President Trump in order to pressure the Justice Department to open an investigation of the president.
In a report released last month, Mr. Horowitz wrote that the former FBI director set a dangerous example when he shared the memos to push the Justice Department to act.

This was the investigation for leaking.
The next investigation, which has just been completed, if for far more serious charges.
Comey signed one or more FISA documents allgedly knowing that the documents contained false information. He signed this, under a written oath, which, if the charges are prove, false under the perjury statute.
This report is being reviewed for classified information by the DOJ.
The most serious investigation is still underway, being run by Asst. US Attorney John Durham and is looking into how R$ussia-gate originated.
Comey is far from being out of the woods, and is still in potential legal jeopardy.

Nevermind that we went through this last month.
I am STILL livid AG Barr declined BOTH of Comey’s criminal referrals. Mind boggled. I don’t give a rat’s ass if the cases were weak or AG Barr did not think convictions could be obtained. Merely indicting him for both perjury and again for leaking classified material would provide IMMEDIATE accountability and put the rest of the players on notice.
Absolutely nothing was achieved by declining to prosecute Comey for potential crimes I would certainly be indicted for. Its pure bullcrap.
I don’t want to hear any sorry excuses about indictments to come for FISA. Screw that! Different issue. Comey should have been indicted for both potential crime, and let the courts worry about convicting him. This was not a garden variety event where an AG should look at odds of conviction. Comey’s double indictments were needed to put the coup conspirators on notice and to assure us that accountability will be forthcoming.
Barr screwed up royally. All he did was perpetuate the belief that Comey and the rest of the government top brass are above the law.
Future indictments will be welcome. Better late than never. But Barr completely F’d this up. Royally.
