Gregg Jarrett: Malevolent McCabe’s appointment with justice is imminent

Andrew McCabe is one step closer to a reckoning with justice.

The Department of Justice correctly rejected the equivalent of a Hail Mary appeal from McCabe’s lawyers that he not face criminal charges for lying. U.S. Attorney for the District of Columbia Jessie K. Liu has recommended moving forward against the fired former FBI acting director. Presenting the case to a federal grand jury is likely imminent.

Lest we forget, McCabe has helped put people behind bars for lying. He should be held to the same legal standard.

In a scathing condemnation of McCabe last year, the Department of Justice (DOJ) inspector general – a neutral investigator appointed by former President Barack Obama – concluded that McCabe “lacked candor” on four occasions when questioned by federal agents about leaking information to a reporter.

A lack of candor, mind you, is a polite way of saying McCabe lied – not once, but four times.

McCabe was appropriately fired from the bureau, and the inspector general promptly referred the case to the DOJ for potential criminal prosecution.

Federal prosecutors have spent the better part of 17 months evaluating the incriminating evidence. They have been more than fair in listening to the explanations and excuses offered by defense lawyers.

In his own defense, McCabe claims he was stricken with a sudden onset of incoherence and amnesia. It was all a misunderstanding and miscommunication, he insists.

In the alternative, McCabe avers that it was nothing more than an innocent failure of recollection. Not likely.

None of the people associated with Trump were ever afforded such vapid excuses when Special Counsel Robert Mueller leveled criminal charges for lying against people like Michael Flynn, George Papadopoulos and Roger Stone.

Jarrett could probably be a helluva a Deputy AG, as long as the Swamp Puppet Masters don’t get to him, one way or another. And he seems to really care and be passionate about all the wrongdoings that have gone on for the last 3 years.

Unfortunately, this more Kabuki Theater. Liu knows that if she doesn’t take this perp to trial, she’s done and the Deep State/Swamp need her there. So, look for a very tepid prosecution and resulting acquittal. She and his defense attorney’s will make sure that they get the Whitest, most Liberal, most Trump Hating, most Swamp Loving jury they can from Georgetown and all the other hoity-toity neighborhoods in DC and surrounding areas. Folks, that no matter how bad the crimes were, it was all done to ‘right the wrong’ of November 8, 2016.

Didn’t a juror on the Craig trial, recently, say that the investigation and prosecution of Craig was a complete waste of time while the republic is in trouble. Or something to that effect.

Great point. If he even needs to put up a defense, which I don’t think he will need to do as I’m of the belief that this is Kabuki Theater and nothing else, everything he did will be downplayed. Present that to a sympathetic jury of white, DC liberals that hate the President and he walks.

However, if he appeared before FISC, lied and they can show, definitively, that he committed Perjury, there just might be a very small minute chance that he can get convicted. But, then again, it’s all up to the jury.

From what I've read, nobody appeared before the FISC court. DOJ just dropped it off. Everybody rubber stamped the FISA request including the 4 republican appointed judges. McCabe would just use the Rosenstein defense that it had been approved 3 previous times. Comey signed off the on the first 3 requests for the FBI.

People say you can’t get a conviction in DC but it occurs to me that it will be very easy to hang McCabe, Strzok, Comey, and all of them by pointing out very simply they are “dirty cops”. That will resonate strongly with a DC Jury. They will want to hang them personally.

Wondering; why hasn’t there been any interest in the FISA judge(s) who approved these warrants? Seems to me that they were in on the scheme. After all, how naive can we expect them to be?

That would be his attempt at a defense, but if he signed that thing as the affiant, he’s going to have some explaining to do. Rosenstein has offered that defense during some questioning by the press or some friendly members of Congress, who weren’t going to hold him accountable. He was their guy. In a court of law, when you’re the defendant, it’s “supposed” to be a bit different.

None of these guys has been held accountable, yet.

I’m not confident, but one never knows, until they know.

I truly hope that is the case. But it’ll all depend on who is sitting in that jury box.

If it’s rich, white, liberals from Georgetown or Northern Virginia, that hate the President, I’ll say, Good Luck.

If the jury is made up of “middle class” folks, trying to get by, who know they wouldn’t get away with anything, there’s a chance.

All the people you mention and refer to are still invited to all the right parties to rub elbows and talk about how they almost took down their mortal enemy.

That being said, if one of them is headed to the pokey, for some real time, he’s either taking it all down or he’ll be Epstien’d, in short order so he can’t sing.

It seems to me if they went after one of the major signers, they would have to go after all of them. We know from the congressional testimony of Trisha Anderson, the approvals were top to bottom. She didn’t read the application because it was already approved.

I’m not going to pretend to know much about it, other than reading some articles. But, the rules of Criminal Procedure are the same whether you’re in a city court or FISC.

I used to work with some of the federal agencies when I was a detective. Cops/detectives write their warrants, go before a judge, raise their hands and swear that what is in the warrant is the truth, under penalty of Perjury.

The Feds do things a bit differently as they’ll have agents do the leg work, gather the evidence, and then they’ll work with an AUSA,a who drafts the warrants. Then they both go to the judge.

Maybe FISC works completely different, but at the end of the day, if they knew the basis of the warrant, Steele Dossier, was a lie, the first person that drafted it and every person after it, is guilty of Perjury. If the judge was just rubber stamping the extensions, while they have “judicial immunity”(something they gave themselves that is not actual law), then they can be in trouble as well.

It would be hard to accept that there were a few in the mix that didn’t know exactly what was going on and all played a very willing part. Especially since they all thought she would win and we’d never know a thing about any of this.

McCabe is a small fish. If his hide is all we get, Republican voters should stage a peaceful march on Washington.

Watched Hannity tonight and it was mentioned that McCabe will likely be indicted by the grand jury and will cop a plea deal.

I wouldn't put too much stock in Conservative Porn Hannity.

Nothing is going to happen. For it to a Grand Jury would have to be impaneled, witnesses called and investigations made, and indictments issued. This would take a minimum of a year to two years, after indictments,cases would have to be prepared, motions filed and ruled on. You are looking at a year to two years right there. They may get MCAbe or not, according to how much juice he has.He clearly is not in Comey’s, Hillary’s, or the other’s class. He may and could probably be the scape goat. If I had to make a prediction, I would say nothing will happen to him either. Both the System and the Swamp take care of their own.
