Jussie Smollett Charged With Disorderly Conduct

“Empire” actor Jussie Smollett has been charged with disorderly conduct for allegedly filing a false police report about an attack he said occurred as he walked to his apartment building in Streeterville last month.

The charge, a felony, was announced by the Cook County state’s attorney’s office Wednesday evening, hours after police called Smollett “a suspect in a criminal investigation … for filing a false police report.”

Earlier in the day, attorneys for Smollett, 36, met with prosecutors and detectives but it was unclear if the actor was present, according to police spokesman Anthony Guglielmi. The lawyers, Todd Pugh and Victor P. Henderson, could not be reached for comment. They have been joined by high-profile, Los Angeles-based lawyer Mark Geragos who has represented numerous celebrities, including pop star Michael Jackson, R&B singer Chris Brown and actress Winona Ryder.

On Tuesday, two brothers who had been under arrest in the case appeared at the criminal courthouse, also to talk to prosecutors and detectives, authorities said. They and their attorney, Gloria Schmidt, were seen near the grand jury rooms Tuesday afternoon, but police said they did not appear before a grand jury.

FindLaw: Illinois Disorderly Conduct Laws

[Illinois] Misdemeanor charge can result in a sentence of imprisonment for up to 30 days, six months, or one year, depending on whether the state charges the offense as a Class C, Class B, or Class A misdemeanor. The state may also impose a fine in a maximum amount between $1,500 and $2,500.

Disorderly conduct charged as a felony may result in an increased punishment. A Class 4 felony may result in a term of imprisonment for one to three years, while a Class 3 felony can lead to a sentence of two to five years. For a Class 3 felony, the Illinois disorderly conduct laws specifically require a fine in an amount between $3,000 and $10,000.

For each sentence, state law requires an additional penalty of 30 to 120 hours of community service if available in the local area.

Don't hold your breath. I can assure you that the Chicago/Illinois Machine has sent out the "Bat Signal" and all this is going to "go away" very shortly.

Other than a few hours in jail between arrest, arraignment and posting bail, Jussie never sees a single day in the klink.

This is a felony with upwards of 3 years in prison. Even if you think he might get out of this there’s still the fake letter matter which is a serious federal crime

It is the strongest charge you can get for filing false reports in Illinois.

He didn't just file a false report. He directed and participated in a fraudulent act.

Darling Mad Maxine Waters was in the audience, front row I suspect, when he made his first performance at the Troubadour in L.A. after the oh so ‘vicious’ attack, look to her, too.
