he Ninth Circuit Court of Appeals sided with the Department of Justice (DOJ) in a Dec. 26 ruling largely missed by major media outlets. 'Missed' only because it was a preliminary win for the Trump Administration. Had it gone the other way, it would have been the lead for a week.

This is only an order that certifies an interlocutory appeal to decide any legal questions that have arisen in the underlying case. Nothing will stop the 9th from deciding these questions and then sending it back for trial.
IOWs this is what the American judiciary does best - let lawyers rack up fees going through legal process rather than deciding a case on the clearly transparent issue that you should not be able to sue the government for deciding political questions on climate change.
