Missing Flynn document in Mueller file could rile judge at sentencing hearing

Exactly.

I think soetoro's pal,Sally Yates, sent them to manufacture a perjury charge.

She's the one that brought up the Logan Act but Flynn did nothing illegal in talking to Kisylak as he was the National Security Advisor to the President Elect.

They already knew what was said as they tapped the call and then illegally unmasked Flynn.

The FIBBERS don't record interviews or interrogations because it would make it too difficult for them to lie.

Would that seriously happen in your example? You’d be charged for lying to an FBI agent even if the conversation was outside the bounds of an investigation and was for lack of better words, “off the record”?

So basically the FBI can lie to their hearts content even if only to get someone else to lie to them in order to charge that person for lying to an FBI agent? Is that the double standard? Is that how it w0rks?

You can’t delete what never was in the first place.

Mueller made its existence up to begin with, never having anticipated being made to produce it.

Sullivan signed an order back in Feb 2018 for Mueller to hand over to Flynn, exculpatory evidence. If it was not material, Mueller was to still submit it to the court for an “in camera” review.

I never saw any outcome of this order.

This is the same judge who freed Sen. Stevens because the prosecutors withheld exculpatory evidence.

The Fourteenth Amendment places fundamental constraints on the government in securing a guilty plea. There are two bedrock points of law that work against coerced false guilty pleas: all exculpatory material must have been disclosed to the defendant before the guilty plea, and the existence of the underlying crime charged must be supported by established facts.

Judge Smith's demand for pertinent documents gets to the heart of the matter because the next questions are whether those documents were provided to the defense and whether are sufficient facts to show that a crime was actually committed by General Flynn. If not, the validity of Flynn's guilty plea is in doubt and should not be accepted by the court. Notably, Judge Smith could go on to enforce the benefits to Flynn of the guilty plea and impose other sanctions for misconduct on the government and its attorneys. Judge Smith could thereby end the prosecution of General Flynn and give the Special Counsel some well-deserved judicial pushback.

I commented on that article thread that if the 302 report had been filed under seal, surely Judge Sullivan would have already known that on Wednesday when the original sentencing report was submitted. And since Sullivan demanded the original Pientka 302 be turned in by Friday, why didn't Mueller just tell him that it had already been submitted under seal on Wednesday? If Mueller did file it under seal on Friday, it hasn't been reported. There's isn't any ban on the media reporting that sealed documents were turned over to the court is there?

While Mueller should be jailed for contempt and held in a cell until such a time as all the requested original documents are produced in unredacted form, we all know deep down that he'll get little more than a rap on the knuckles with a ruler and a stern scolding.

Our justice system has become truly pathetic.
