Andrew C. McCarthy: Why Trump is likely to be indicted by Manhattan US Attorney

The major takeaway from the 40-page sentencing memorandum filed by federal prosecutors Friday for Michael Cohen, President Trump’s former personal attorney, is this: The president is very likely to be indicted on a charge of violating federal campaign finance laws.

It has been obvious for some time that President Trump is the principal subject of the investigation still being conducted by the U.S. attorney for the Southern District of New York.

..But when Cohen pleaded guilty in August, prosecutors induced him to make an extraordinary statement in open court: the payments to the women were made “in coordination with and at the direction of” the candidate for federal office – Donald Trump.

...Moreover, campaign finance infractions are often settled by payment of an administrative fine, not turned into felony prosecutions. To be sure, federal prosecutors in New York City have charged them as felonies before – most notably in 2014 against Dinesh D’Souza, whom Trump later pardoned.

In marked contrast, though, when it was discovered that Barack Obama’s 2008 presidential campaign was guilty of violations involving nearly $2 million – an amount that dwarfs the $280,000 in Cohen’s case – the Obama Justice Department decided not to prosecute. Instead, the matter was quietly disposed of by a $375,000 fine by the Federal Election Commission.

Of course not. The two cases are completely different. Obama was a light-worker whose presence in office made the seas recede, brought peace and prosperity to a troubled world, and left Ben Laden dead and GM alive; Orange man bad!

Don’t forget that McCarthy started out as a NeverTrumper, then switched to supporting President Trump.

At the end of the article McCarthy gives Trump’s side of argument.

It’s also posted on FoxNews, who has lurched to the left, considerably.

I think if you add it all together, it’s basically click bait.

“Campaigns” are creations of State Legislatures, and they are for the purpose of guiding the Legislature in its plenary power to appoint Electors for President and Vice President.

No “rules” or “laws” made at the Federal level (by Congress OR the Executive Branch) have any sway over the processes by which the State Legislatures indirectly elect the President. The voting pertaining to Electors that takes place on the Tuesday after the first Monday in November are NOT Federal elections, they are 50 State elections to appoint State officers (the Electors).

Search the Constitution all you like. Congress has no authority over the appointment of Electors, and any laws that say otherwise are unconstitutional.

I won’t be surprised if they do just from the aspect of another smear on Trump, that the MSM and democrats will harp on 24/7. It will be just another smear to play out the clock.

We are all waiting impatiently for Trump to declassify documents. At some point in time, Trump has to play his cards. He just has to.

For instance, what Comey hid behind during his questioning — “I can’t speak about an ongoing investigation” — Trump should declassify every possible thing associated with the investigation. Everything.

And then wrap these bastards up for the next thirty years.

I posted yesterday, before this article came out, what was up with the SDNY being involved with this and that they would charge Trump. The entire game is to get him to resign in exchange for not being indicted/impeached.

If a trial is held in NYC, all they need to do is convince 12 liberals that Donald Trump deserves punishment. It could be for breathing too much air. Doesn’t matter. A jury in the right city will convict.

As a sitting President, it probably doesn’t matter. While he is in office. But if it goes to impeachment, will Republican senators REALLY vote not guilty? Well, probably enough to stop the impeachment.

Practically, it would fire up the GOP base beyond the moon. I think a lot of independents also see this for what it is: pressing criminal charges for the crime of beating Hillary in 2016. The Democrats are criminalizing politics. To win against a democrat is a crime. Just ask California.

This EVIL must be fought at every level!

It is all moot anyway - he used his own funds, which is well within the law.

Ok , if indictments come, Trump will need to play the trump cards and declassify anything that hurts the deep state.

I think the deep staters are trying to draw this thing out to 2020 election. So, Trump needs to move up the timetable and make everyone play their cards sooner than later.
