The major takeaway from the 40-page sentencing memorandum filed by federal prosecutors Friday for Michael Cohen, President Trumps former personal attorney, is this: The president is very likely to be indicted on a charge of violating federal campaign finance laws.
It has been obvious for some time that President Trump is the principal subject of the investigation still being conducted by the U.S. attorney for the Southern District of New York.
..But when Cohen pleaded guilty in August, prosecutors induced him to make an extraordinary statement in open court: the payments to the women were made in coordination with and at the direction of the candidate for federal office Donald Trump.
...Moreover, campaign finance infractions are often settled by payment of an administrative fine, not turned into felony prosecutions. To be sure, federal prosecutors in New York City have charged them as felonies before most notably in 2014 against Dinesh DSouza, whom Trump later pardoned.
In marked contrast, though, when it was discovered that Barack Obamas 2008 presidential campaign was guilty of violations involving nearly $2 million an amount that dwarfs the $280,000 in Cohens case the Obama Justice Department decided not to prosecute. Instead, the matter was quietly disposed of by a $375,000 fine by the Federal Election Commission.

If Trump paid of these women to spare his wife from embarrassment, it is not for the purpose of a campaign. It may also be for the purpose of the campaign, but it is not the primary reason.
It’s nonsense. 1) can’t indict a sitting President 2) they have to prove he knew it was against the law 3) they have to prove it was a violation of the law 4) a candidate is allowed to put as much of his own money into his candidacy as he/she wants 5) he used his own private money to settle a potential lawsuit even if he also used his own money to finance his campaign 6) the main witness is lying because he said two exactly opposite claims, one before he was convicted on unrelated charges and one after which is the truth 7) flipping a person’s own attorney into a witness against the accused won’t sit well with the courts or the bar association...
Nobody but Trump would get charged for this. The comparison to Dinesh is not accurate. Dinesh knowingly bundled campaign contributions and then personally reimbursed the contributors with his own money. It doesn’t compare to a person running for office and using his own money both to fund the campaign and to settle lawsuits. On the face nothing of this is a crime, they want to make it appear as a crime but it just isn’t one.
Time to start hauling everyone involved in the Dossier and DNC Lawfirm Russia Collusion before a grand jury. Goose & gander and all.

The DOJ guidelines are that a sitting president cannot be indicted, this has been stated time and time again, McCarthy knows this, so why is blathering this crap? Even so, Trump will not be removed from office unless two thirds of the senate votes to convict—which WILL NEVER HAPPEN!!! This entire witch hunt is nothing more than a waste of money and time. Mulehead should be indicted for sedition, and if we had an attorney general with testicles, this would be over.

John Edwards paid his mistress hush money with campaign fund donations. He was indicted, and found not guilty by the jury in a Federal Court. I hope they have fun trying to indict Trump for reimbursing his lawyer from his own pocket
Yeah, this is where the concern is. It’s not with collusion as I still believe there is none. It’s with these payments.
In retrospect, the women coming out accusing Trump in October didn’t affect him, so I don’t know think these women would have had their allegations come out. That said, I don’t remember when it was they were going to make them - if it was in the summer, they may have led to problems with him securing the nomination & they may have compounded with the Access Hollywood Tape.
If he’d personally paid them and not utilized Cohen, he could have said it wasn’t a campaign expense because he would have paid them anyway because he’s a businessman, has clubs, has a show, has a public persona, and has a wife and kids. I really do believe he would have paid them anyway, and that should be his defense.
A US Attorney can’t indict a president. Trump can use his own money and that’s what he did.

If McCarthy is correct, Trump, if convicted of something, could say to the court, look what DOJ/the courts didn’t do to the Obama campaign in a case involving way much more money than mine.
