CNN) The White House has issued a new warning to CNN's Jim Acosta, saying his press pass could be revoked again at the end of the month.
In response, CNN is asking the U.S. District Court for another emergency hearing.
"The White House is continuing to violate the First and 5th Amendments of the Constitution," the network said in a statement Sunday. "These actions threaten all journalists and news organizations. Jim Acosta and CNN will continue to report the news about the White House and the President."
Last Friday CNN won a temporary restraining order, forcing the White House to restore Acosta's press access to the White House for 14 days. Judge Timothy J. Kelly ruled on Fifth Amendment grounds, saying Acosta's right to due process had been violated. He did not rule on CNN's argument about First Amendment violations.
Later that same day, the White House sent Acosta a formal letter outlining a "preliminary decision" to suspend his pass again once the restraining order expires. The letter cited his conduct at President Trump's November 7 press conference.
The letter was signed by two of the defendants in the suit, press secretary Sarah Sanders and deputy chief of staff for communications Bill Shine.
The letter signaled that the Trump administration wants to continue fighting Acosta, despite the round one setback in court, rather than seeking an out-of-court settlement.

But if you get a drivers license, you have to go through ‘due process’ to get it revoked, or you might actually have grounds.
Don’t get me wrong, I’m not in CNN’s court, but I think I get the tack they are using. It’s weak, and the White House will eventually win. They just have to set up some policies by which they can revoke press passes.

Call on him first at every presser. If he goes beyond the one question or gets combative, shut down the presser. After a couple of those, the WH can claim Acosta is ruining it for everyone.

Judge all ready ruled against them on their fraudulent claims for 1st Amendment protections. Instead he manufactured a fraudulent due process claim to keep from having The Press attack him
Yep. This judge doesn’t want to be doxed by CNN. Or have Democrats wearing masks banging on his door at 0 dark 30 and scaring his children. Understandable, really.
The idiot judge Kelly will determine that Acosta has a right based on the 18th Amendment because Trump is denying Acosta the right to attend White House cocktail parties and the 19th and 13th Amendments because if Trump can bar Acosta, what will stop him from barring April Ryan, a black female.
That’s the kind of weird, flawed logic being used by these Trump hating Federal judges these days.
I couldn't care less about the hijinks of press pool reporters. They are just hired help, sent to the White House press pool to ask the questions dictated to them by their superiors.
The Constitution doesn’t give journalists the right to accost a White House aide. they’ve made it clear that CNN is welcome but Accosta has worn out his. He is a big bully. Being a part of that press corps is a privilege, not a right.
This whole thing reminds me of the drama of 2’nd grade.
I’m never going to miss a presser again. But I’ll be watching it on Fox.

THAT’S the problem - they don’t report news ABOUT the White House or the president. Is he talking about “FROM the White House?” News about either should be done from their studios not at briefings. They don’t need to be IN THE WHITE HOUSE to report anything. They can ask pertinent questions regarding ongoing issues, receive the replies and LEAVE!! They are there - especially CNN - with other trouble makers to do just that - MAKE TROUBLE... When have they EVER listened to replies?
I’ve said ad nauseum that Trump should limit the press briefings to once a week on Friday. Everyday is totally unnecessary.
Tell the judge to pound sand.
