Judge Grants CNN’s Motion to Restore Jim Acosta’s White House Press Pass

The cable network made an emergency request so its correspondent could have access to the White House as lawsuit continues.

WASHINGTON—A federal judge granted an emergency motion to restore the White House press credential of CNN correspondent Jim Acosta—a victory for the network in a closely watched press-freedom case.

The lawsuit could determine whether the government can ban individual reporters from public buildings.

District Judge Timothy Kelly, who was appointed to the bench by President Trump, granted CNN’s request for a restraining order temporarily restoring Mr. Acosta’s press access to the White House while the case proceeds.

Lawyers for Mr. Acosta, the network’s chief White House correspondent, argued that the unusual revocation of a reporter’s press pass by the White House last week necessitated emergency action.

Mr. Trump has regularly attacked CNN, and Thursday’s ruling was a setback for the White House. Government lawyers acknowledged in court they knew of no other situation where the White House had revoked a press pass under similar circumstances.

The legal maneuvering was part of a CNN lawsuit alleging that the Trump administration violated Mr. Acosta’s First Amendment right to gather news, as well as his due-process right to challenge a government-imposed punishment. Judge Kelly didn’t rule on the merits of CNN’s overall case.

Fair enough. I would reinstate it, along with 150 other ADDITIONAL press members who will also get passes as well. But this will now require overflow seating and an updated seating plan. A nearby outdoor tent for simulcast press briefings would be erected and Acosta will find his seat located there.

Nor do they need to host any press whatsoever.

They can appeal this as it some lame standard about “due process” like the reporter should be given a hearing about having access yanked to the White House.

It’s a ridiculous self-important standard set by this judge.

I say let him back in then NEVER call on him again.

To that, CNN will sue again, and a judge will order the president to answer Jim Acosta's questions. And Jim Acosta will not be required to give back the mic back until Jim Acosta says that he's done.

I think it is time to hire a team and seriously ramp up news dissemination through non-traditional outlets like Twitter.

Acosta is preventing the news from being disseminated, and that is a problem because people are going to continue to look for news and many outlets are of questionable worth. If White House briefings are shut down then the administration is being effectively muzzled. So ramp up in other media sources and maybe take a page from the Obama administration by cultivating friendly press, very carefully.

Jeezus, looks like everyone has boarded the stupid train.

Once again, this isn't about issuing new press passes, but revoking one that had already been granted. That's the starting point - you cannot unilaterally seize and/or deny an "asset" without due process aka 5A.

The incredibly simple solution is to merely establish a set of rules for standards of conduct. The penalties for violation include suspension, revocation and/or ejection.

What the court has done is allow Trump to now create an environment that controls the wide open wild west nonsense.

I can not believe this crap! What is going to keep the rabid press in line from now on? They know they can’t be tossed. So Jim Acosta has more rights than the average citizen? Mr. President,just ignore this order and say Acosta’s pass will not be reinstated under any circumstances. Jeez..enough already.

You can attend, just don’t plan on being called on.

Before doing this, state a policy of conduct to disqualify reporters who interrupt other reporters or hog the microphone.
