The Justice Department responded to CNN's lawsuit over the revocation of Jim Acosta's press pass on Wednesday, saying in a court filing that the White House rejects the idea that it can't pick and choose which journalists can be given a permanent pass to cover it. "The President and White House possess the same broad discretion to regulate access to the White House for journalists (and other members of the public) that they possess to select which journalists receive interviews, or which journalists they acknowledge at press conferences," lawyers say in the filing.
Both CNN and Acosta are plaintiffs. The suit alleges that their First and Fifth Amendment rights are being violated by the ban.
Judge Timothy J. Kelly, a Trump appointee, has scheduled a hearing for Wednesday at 3:30 p.m.

Yep, keep it simple.
The White House is the President’s ‘residence’, he can bar anyone from entering.
So, if CNN has a magic right to be in the White House, under 1st and 5th Amendment Rights, then I have a magic right to go on their network anytime I want. If they say no, then, I could sue them for violating my 1st and 5th Amendment Rights.
The same way they handle unruly, and out of control guests/contributors. They shut off their mics, suspend/fire/blackball them from appearing again. Nothing different than what The White House did.

That wouldn’t be enough. They would demand that he get to ask questions. If he puts him in the back of the room, they would demand that he gets to sit in the front.
This is a fight worth fighting, and if it can be drawn out about six months, then it would take care of Acosta at the same time.
I can’t believe he even has to respond to this. Is there nothing the court does not have final say over? How about the President’s bathroom breaks? What if he excuses himself to go to the bathroom during a press conference? Could the court rule that that was unconstitutional?
What bothers me is, that if the courts rule against him, Trump might comply.

The old saying is the only thing worse than not getting what you want is getting what you want. If Acosta wins this stupid court case then the WH should *only* let Acosta speak, and speak, and speak. The answer to his question, if there actually ever is a question, is “no comment”. If Acosta has no more questions. End the news conference. Rinse and repeat. Acosta will “own” the news conference.
But obamy is half black v. Trump who’s all white.
You must be a victim of the government runs school system. The 1st and 5th Amendments protect us from the government and have no application to private entities like CNN.
That is why I said magic right, not actual right. And yes I understand the Constitution and Bill of Rights, even though I have a Gov’t school edumication. Plus an evil College degree.
I’ve been saying for decades that the White House is not an office for the media. With web access, all Americans can get the WH news directly from the WH, with the press office giving statements every day on the issues. Then, if desired, they can send an email to a a specific address with a question they’d like answered. The major media itself would be neutralized and there is nothing wrong with doing that.
I never paid any attention to Obama era news conferences. They were jokes. The media is there now for a sideshow. They have no interest in reporting the news.

Simple fix. Quit having press conferences. It worked for Hillary during her election stealing attempt.
