A federal appeals court is weighing whether special counsel Robert Muellers appointment to lead the Russia investigation was constitutional.
At issue Thursday is whether Deputy Attorney General Rod Rosenstein had the authority to appoint Mueller.
The special counsels office says yes. But lawyers for a former aide to longtime Trump confidant Roger Stone say no.
The aide, Andrew Miller, brought the case because he doesnt want to testify before a grand jury as part of Muellers investigation into whether Donald Trumps Republican campaign coordinated with Russia in 2016.

Yes, it would, but won’t happen. The DOJ uses outside lawyers for all sorts of ‘task forces’. Those prosecutions are not going to be put in jeopardy.
I don’t see the argument as to why the appointment of a SC was not legal in this article.
You won’t see it in any AP article either.

Usually it’s the Steven Calebresi argument that the SC is a ‘principal officer’ and requires Senate confirmation.
It’s already been ruled an invalid argument in one court case.

A "Assistant / Deputy U.S. Attorney General {Rob Rosenstien,}" must be / was CONFIRMED BY THE U.S. SENATE.
IIRC, the U.S. Code sets out just how the chain of command is to be structured if the U.S. Attorney General, either should die while in office, and or "RESIGNS" vs being "FIRED."
No where, in U.S. Code is a provision for the APPOINTMENT for a Special Prosecutor.
No where, in U.S. Code is a provision for the APPOINTMENT of any position (lets say dog catcher) that the U.S. Senate doesn't get to weight in on.
For those saying the U.S. Attorney's office uses outside legal counsel (I would argue that's no different then hiring someone to drive your car from point "A" to point "B." You still own the car, not the person hired to drive from point "A" to "B.") Or to put it another way, for those with a little more legal knowledge, they will hire

The U.S. Attorney General files the complaint / brings the charges (i.e. OWNS THE CAR) and simply hires a driver / in legal parlance hires "Second Chair."
Major HINT: I would argue the "APPOINTMENT of a Special Prosecutor." is similar in it's MIS-Interpretation as the 14 Amendment ref: illegals birthrights to become U.S. citizens.
So have at it, and chew my ear's off.
I'll bet they are arguing Mueller was appointed unconstitutionally and lacks "Subject Matter Jurisdiction."
