Victim's girlfriend says Florida gunman provoked fatal 'stand your ground' shooting

Britany Jacobs, the girlfriend of the man shot and killed in a Florida parking lot last week, says her boyfriend was just coming to her defense and the gunman “wanted someone to be angry at.” Now she wants “justice,” she says.

Jacobs, who witnessed the shooting along with the couple’s 5-year-old son, said she and her two small children were waiting in the car for her boyfriend, Markeis McGlockton, while he ran into a convenience store in Clearwater, Florida. Onlooker Michael Drejka got out of his parked car and began “harassing” her about being parked in a handicap space, she said.

Surveillance video showed McGlockton exiting the store and shoving Drejka to the ground. Drejka then drew a handgun and shot and killed McGlockton.

It has been reported down here that the ‘shooter’ has done this several times before, waits until someone parks in the handicap space and then gets out of his car and berates them for it...............

"berating" people for parking in handicapped spots is not illegal. Viciously shoving someone to the ground is.

Instead of throwing someone to the ground why didn't the assaulter call the police and say someone was harassing his GF?

Nobody was killed over a parking space.

Somebody was killed because he physically attacked another.

The only difference of opinion here is what was justified AFTER the Man was Assaulted. If he had hit his head on the pavement and died from his injury, would we be blaming the Assailant, the dead Victim of the Assault or the Parking Place?

My personal OPINION, the Victim of the Assault shouldn’t have shot his Assailant when just brandishing his Weapon seemed to have ended the threat.

Then again, I’m not the guy who just got punched and was lying on the ground fearful of further violence.

The Police and the Legal System are the ones who are tasked with sorting out the facts.

If the Shooter was a White Hispanic, this situation will really get dicey.

She not only got out, but she got out the instant her boyfriend comes out of the store.

This is ghetto technique to distract the guy so the other thug can get a clean run at the guy without warning. You'll find that surround and distract trick in so many Youtube ghetto mob attack videos.

If the guy didn't plug the man, both of them would have stomped him to "death or serious bodily harm."

I’m seeing it the same way. It seems pretty obvious from the tape that he didn’t have to shoot the guy. But I will also say that once you put your hands on another man in violence, you are taking a risk with your life.

I have very little sympathy for the guy that allowed himself to get too angry about the parking infraction, took matters into his own hands to give the female of the two grief over it, and then objected to the male figure separating the two of them by pushing him away.

Pulling a weapon and shooting a man who pushed you away from yelling at his wife, just doesn’t seem warranted to me.


Have you watched the video? Your description of what happened does not bear much resemblance to the video I saw.

The District Attorney hasn't made a decision.

Stand Your Ground doesn't apply because that only applies to whether someone has a duty to retreat before using otherwise justifiable deadly force in self-defense. Stand Your Ground does not refer to all aspects of self-defense, only the duty to retreat. In this case, being shoved to the ground and still on the ground, had the shooter been facing an imminent deadly threat, he would have had no duty to retreat because even in non-SYG jurisdictions you only have to retreat if you can do so safely.

But SYG does not equal "self defense". Even with SYG, self-defense still has to be justified by all the other criteria. There must be a reasonable perception of an imminent deadly threat. That's going to be hard to show here.

And the reason he hasn't been charged yet isn't SYG either. It's because Florida has a different law, Self Defense Immunity. And that one means that you can't be arrested in a case of possible self-defense until they decide to file charges.

There are two separate issues. According to the articles, the sheriff decided BOTH that the stand your ground applied, and that the shooting was justified - while also suggesting potential disagreement with laws.

The stand your ground laws doesn’t allow you to shoot, it merely allows you to not have to flee. Other laws determine whether you may shoot within the law.

I wonder if you would be whistling a different tune if one of your family members had been killed over a parking space.

It wasn't over a parking space. It was the result of two emotionally immature people with poor impulse control clashing with one another. The parking space issue was simply the one that got the ball rolling.

A person who initiates violence, especially against a smaller and weaker party, has no valid complaint against violence used against him.

There’s an old phrase that goes: never pick on a smaller man, he will kill you. The smaller man has to fight with everything he has because the larger one is the only one in such a confrontation who can stop it anytime he chooses.

I guess so. The law doesn't justify shooting someone as the response to any "attack". It must be an imminent deadly threat. This clearly wasn't.
